마약류 불법거래 방지에 관한 특례법 제76조(검사의 처분)

① 검사는 이 장에 따른 몰수보전 또는 추징보전청구, 몰수보전명령 또는 추징보전명령의 집행에 관하여 필요하다고 인정하면 관계인의 출석을 요구하여 진술을 들을 수 있고, 감정ㆍ통역 또는 번역을 촉탁하거나 실황(實況)을 조사할 수 있으며, 서류나 그 밖의 물건의 소유자ㆍ소지자 또는 보관자에게 그 제출을 요구하거나, 공공기관이나 그 밖의 단체에 대하여 그 사실을 조회하거나 필요한 사항을 보고하도록 요구할 수 있다.

② 검사는 이 장에 따른 몰수보전 또는 추징보전의 청구, 몰수보전명령 또는 추징보전명령의 집행에 관하여 필요하다고 인정하면 지방법원판사에게 청구하여 발급받은 영장에 의하여 압수ㆍ수색 또는 검증을 할 수 있다.
