마약류 관리에 관한 법률 시행령 제20조의8(하수역학 마약류 사용 행태조사의 내용 및 방법 등)
Enforcement Decree of the Act on the Control of Narcotics, etc., Article 20-8 (Content and Methods, etc. of Wastewater-Based Epidemiology Surveys of Narcotics Use Patterns)
① 법 제51조의7에 따라 「하수도법」 제2조제9호에 따른 공공하수처리시설 등에서 하수를 채집하여 마약류 사용 행태를 추정ㆍ분석하기 위한 조사(이하 "하수역학 마약류 사용 행태조사"라 한다)의 내용은 다음 각 호와 같다.
(1) The content of surveys to estimate and analyze patterns of narcotics use by collecting sewage at public sewage treatment facilities, etc. under Article 2, subparagraph 9 of the Sewerage Act, pursuant to Article 51-7 of the Act (hereinafter referred to as "wastewater-based epidemiology surveys of narcotics use patterns") is as follows:
1. 마약류의 종류, 검출량 등의 모니터링 및 마약류 사용 현황에 관한 사항
1. Matters concerning monitoring of the types and detected amounts of narcotics and the status of narcotics use;
2. 하수가 채취된 지역별, 시기별 특성 등을 고려한 마약류의 사용량 추정 및 분석에 관한 사항
2. Matters concerning estimation and analysis of narcotics use taking into account the characteristics by region and period in which the sewage was collected;
3. 그 밖에 식품의약품안전처장이 하수역학 마약류 사용 행태조사를 위하여 필요하다고 인정하는 사항
3. Other matters that the Minister of Food and Drug Safety deems necessary for wastewater-based epidemiology surveys of narcotics use patterns.
② 식품의약품안전처장은 하수역학 마약류 사용 행태조사를 문헌조사, 현장조사 또는 그 밖에 식품의약품안전처장이 정하는 방법으로 실시할 수 있다.
(2) The Minister of Food and Drug Safety may conduct wastewater-based epidemiology surveys of narcotics use patterns by literature survey, on-site survey, or other methods determined by the Minister of Food and Drug Safety.
③ 법 제51조의7제3항 전단에서 "대통령령으로 정하는 관계 기관 또는 단체"란 다음 각 호의 기관 또는 단체를 말한다. <신설 2025.9.9, 2026.1.27>
(3) The term "relevant agencies or organizations prescribed by Presidential Decree" in the first sentence of Article 51-7 (3) of the Act means the following agencies or organizations:
1. 국립ㆍ공립 연구기관
1. National or public research institutes;
2. 「정부출연연구기관 등의 설립ㆍ운영 및 육성에 관한 법률」 제8조에 따라 설립된 정부출연연구기관
2. Government-funded research institutes established under Article 8 of the Act on the Establishment, Operation, and Fostering of Government-Funded Research Institutes;
3. 「과학기술분야 정부출연연구기관 등의 설립ㆍ운영 및 육성에 관한 법률」 제8조에 따라 설립된 과학기술분야 정부출연연구기관
3. Government-funded research institutes in the field of science and technology established under Article 8 of the Act on the Establishment, Operation, and Fostering of Government-Funded Science and Technology Research Institutes;
4. 「특정연구기관 육성법」 제2조에 따른 특정연구기관
4. Specific research institutes under Article 2 of the Specific Research Institutes Promotion Act;
6. 「기업부설연구소등의 연구개발 지원에 관한 법률」 제7조제1항에 따라 인정받은 기업부설연구소
6. Corporate research institutes recognized under Article 7 (1) of the Act on Support for Research and Development by Corporate Research Institutes, etc.;
7. 「민법」 또는 다른 법률에 따라 설립된 법인인 연구기관
7. Research institutes that are corporations established under the Civil Act or other statutes;
8. 「민법」에 따라 설립된 법인 중 하수역학 또는 마약류에 관한 연구를 수행하는 전문학회
8. Among corporations established under the Civil Act, specialized academic societies that conduct research on wastewater-based epidemiology or narcotics;
9. 그 밖에 하수역학 또는 마약류 사용 행태조사 분야에 전문성이 있다고 식품의약품안전처장이 인정하는 기관 또는 단체
9. Other agencies or organizations that the Minister of Food and Drug Safety recognizes as having expertise in wastewater-based epidemiology or narcotics use pattern surveys.
④ 식품의약품안전처장은 법 제51조의7제3항 전단에 따라 업무를 위탁하는 경우에는 위탁업무의 내용과 수탁기관을 고시해야 한다. <신설 2025.9.9>
(4) When entrusting duties under the first sentence of Article 51-7 (3) of the Act, the Minister of Food and Drug Safety shall publicly notify the content of the entrusted duties and the entrusted agency.
