법 제50조 단서에서 "「초ㆍ중등교육법」 제2조에 따른 학교 또는 동물실험시행기관 등이 시행하는 경우 등 농림축산식품부령으로 정하는 경우"란 「초ㆍ중등교육법」 제2조에 따른 학교(「영재교육 진흥법」 제2조제4호에 따른 영재학교를 포함하며, 이하 이 조에서 "학교"라 한다) 또는 동물실험시행기관이 시행하는 해부실습으로서 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
"Cases prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs, such as where it is conducted by a school under Article 2 of the Elementary and Secondary Education Act or an institution conducting animal experiments" in the proviso of Article 50 of the Act means dissection practice conducted by a school under Article 2 of the Elementary and Secondary Education Act (including gifted schools under Article 2, subparagraph 4 of the Act on the Promotion of Education for the Gifted; hereinafter referred to as "school" in this Article) or an institution conducting animal experiments that falls under any of the following:
1. 학교가 동물 해부실습의 시행에 대해 다른 동물실험시행기관의 윤리위원회(법 제51조제2항에 따라 윤리위원회를 설치하는 것으로 보는 경우 같은 조 제2항 각 호에 따른 공용동물실험윤리위원회 또는 실험동물운영위원회를 말한다)의 심의를 거친 경우
1. Where a school has obtained deliberation on the conduct of animal dissection practice by the ethics committee of another institution conducting animal experiments (referring to the shared animal experiment ethics committee or laboratory animal steering committee under the subparagraphs of Article 51 (2) of the Act where an ethics committee is deemed to have been established under the same paragraph);
2. 학교가 다음 각 목의 요건을 모두 갖추어 동물 해부실습을 시행하는 경우
2. Where a school conducts animal dissection practice meeting all of the following requirements:
가. 동물 해부실습에 관한 사항을 심의하기 위해 학교에 동물 해부실습 심의위원회(이하 "심의위원회"라 한다)를 둘 것
(a) An animal dissection practice deliberation committee (hereinafter referred to as "deliberation committee") shall be established in the school to deliberate on matters concerning animal dissection practice;
나. 심의위원회는 위원장 1명을 포함하여 5명 이상 15명 이하의 위원으로 구성하되, 위원장은 위원 중에서 호선하고, 위원은 다음의 사람 중에서 학교의 장이 임명하거나 위촉할 것
(b) The deliberation committee shall consist of at least five and not more than 15 members, including one chairperson, and the chairperson shall be elected from among the members, and the members shall be appointed or commissioned by the head of the school from among the following persons:
1) 과학 과목과 관련 있는 교원
1) Teachers related to science subjects;
2) 시ㆍ도 교육청 소속 공무원 및 그 밖의 교육과정 전문가
2) Public officials affiliated with the Si/Do office of education and other curriculum experts;
3) 학교의 소재지가 속한 시ㆍ도에 거주하는 수의사, 「약사법」 제2조제2호에 따른 약사 또는 「의료법」 제2조제2항제1호부터 제3호까지의 규정에 따른 의사ㆍ치과의사ㆍ한의사
3) Veterinarians, pharmacists under Article 2, subparagraph 2 of the Pharmaceutical Affairs Act, or medical doctors, dentists, or Korean medicine doctors under Article 2 (2) 1 through 3 of the Medical Service Act residing in the Si/Do in which the school is located;
4) 학교의 학부모
4) Parents of students of the school;
다. 학교의 장이 심의위원회의 심의를 거쳐 동물 해부실습의 시행이 타당하다고 인정할 것
(c) The head of the school shall recognize, after deliberation by the deliberation committee, that the conduct of animal dissection practice is appropriate;
라. 심의위원회의 심의 및 운영에 관하여 별표 8의 기준을 준수할 것
(d) The standards in attached Table 8 shall be complied with regarding the deliberation and operation of the deliberation committee;
3. 동물실험시행기관이 동물 해부실습의 시행에 대해 윤리위원회(법 제51조제2항에 따라 윤리위원회를 설치하는 것으로 보는 경우 같은 조 제2항 각 호에 따른 공용동물실험윤리위원회 또는 실험동물운영위원회를 말한다)의 심의를 거친 경우
3. Where an institution conducting animal experiments has obtained deliberation on the conduct of animal dissection practice by an ethics committee (referring to the shared animal experiment ethics committee or laboratory animal steering committee under the subparagraphs of Article 51 (2) of the Act where an ethics committee is deemed to have been established under the same paragraph).
