독립유공자예우에 관한 법률 제13조(사망일시금)

① 보상금을 받고 있는 독립유공자가 사망한 경우에는 그 유족에게 제12조제3항부터 제5항까지에 규정된 보상금 지급 순위에 따라 사망일시금을 지급한다. 이 경우 유족이 없으면 사망 당시 생활을 같이 하고 있던 친족 중 재산상속인이 될 자의 신청에 따라 그 재산상속인에게 지급한다.

② 보상금을 받고 있는 독립유공자의 유족이 사망한 경우에 지급하는 사망일시금은 그 보상금을 받을 수 있는 다른 유족이 없는 경우에만 지급하되, 사망 당시 생활을 같이 하고 있던 친족 중 재산상속인이 될 자의 신청에 따라 그 재산상속인에게 지급한다.

③ 제1항과 제2항의 경우 재산상속인이 될 자도 없는 경우에는 장제(葬祭)를 행하는 자에게 사망일시금을 지급할 수 있다.
