독립유공자예우에 관한 법률 제12조(보상금)

① 보상금은 월액(月額)으로 지급한다.

(1) Compensation캄펀세이션 shall섈 be비 paid페이드 monthly.먼^θ슬리

② 독립유공자와 그 유족 중 선순위자(先順位者) 1명에게는 보상금을 지급한다. 다만, 손자녀일 경우에는 대통령령으로 정하는 생활수준 등을 고려하여 다음 각 호의 사람으로 한정하여 보상금을 지급하고, 이 보상금을 받을 권리는 다른 손자녀에게 이전되지 아니한다. <개정 2014.5.21, 2019.12.10>

③ 보상금을 받을 유족의 순위는 제5조제1항 각 호의 순위에 따른다.

④ 제3항에 따라 보상금을 받을 유족 중 같은 순위자가 2명 이상이면 다음 각 호의 구분에 따라 보상금을 지급한다. <개정 2014.5.21>

⑤ 보상금을 받을 유족이 다음 각 호의 어느 하나에 해당하면 제5조제1항 각 호에 규정된 그 다음 순위의 유족에게 대통령령으로 정하는 바에 따라 보상금을 지급한다.

⑥ 보상금의 지급 수준은 「통계법」 제3조제2호에 따라 국가데이터처장이 지정하여 고시하는 통계 중 가계조사통계의 전국 가구(家口) 가계소비지출액 등을 고려하여 독립유공자의 희생과 공헌의 정도에 상응하게 결정하여야 한다. <개정 2025.10.1>
