도시재생 활성화 및 지원에 관한 특별법 제22조(도시재생활성화계획의 효력 상실 등)

① 특별시장ㆍ광역시장ㆍ특별자치시장 또는 특별자치도지사는 도시재생사업의 추진 상황으로 보아 도시재생활성화계획의 목적을 달성하였거나 달성할 수 없다고 판단하는 때에는 관계 행정기관의 장과 협의한 후 지방위원회의 심의를 거쳐 도시재생활성화계획을 취소할 수 있다.

② 시장ㆍ군수 또는 구청장등은 도시재생사업의 추진 상황으로 보아 도시재생활성화계획의 목적을 달성하였거나 달성할 수 없다고 판단하는 때에는 해당 특별시장ㆍ광역시장 또는 도지사에게 도시재생활성화계획의 취소를 요청할 수 있다. 이 경우 특별시장ㆍ광역시장 또는 도지사는 관계 행정기관의 장과 협의한 후 지방위원회의 심의를 거쳐 도시재생활성화계획의 취소 여부를 결정하여야 한다.

③ 도시재생활성화계획에 국가지원 사항이 포함된 경우 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사 또는 도지사가 제1항 또는 제2항에 따라 도시재생활성화계획을 취소하기 전에 국토교통부장관의 동의를 받아야 한다. 이 경우 국토교통부장관은 관계 중앙행정기관의 장과 협의한 후 특별위원회의 심의를 거쳐 해당 도시재생활성화계획 취소에 대한 동의 여부를 결정하여야 한다.

④ 도시재생활성화계획을 고시한 날부터 3년이 되는 날까지 하나의 도시재생사업도 착수하지 아니한 경우 그 도시재생활성화계획은 취소된 것으로 본다.

⑤ 제4항에 따라 도시재생활성화계획이 취소된 것으로 보는 때에는 해당 도시재생활성화지역의 용도지역은 도시재생활성화계획의 결정ㆍ고시 이전의 용도지역으로 환원되거나 폐지된 것으로 본다.

⑥ 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사 또는 도지사는 제1항 또는 제2항에 따라 도시재생활성화계획을 취소하는 경우 또는 제4항에 따라 도시재생활성화계획이 취소된 것으로 보는 경우에는 대통령령으로 정하는 바에 따라 그 사실을 지체 없이 해당 지방자치단체의 공보에 고시하여야 한다.
