도시교통정비 촉진법 제35조(혼잡통행료의 부과ㆍ징수 등)

① 시장은 통행속도 또는 교차로 지체시간 등을 고려하여 대통령령으로 정하는 바에 따라 혼잡통행료 부과지역을 지정하고, 일정 시간대에 혼잡통행료 부과지역으로 들어가는 자동차에 대하여 혼잡통행료를 부과ㆍ징수할 수 있다.

② 시장은 제1항에 따른 혼잡통행료 부과지역의 지정 목적을 달성하면 그 지정을 해제하여야 한다.

③ 「자동차관리법」에 따른 배기량 1천시시 미만의 승용 자동차는 혼잡통행료의 100분의 50을 감면한다.

④ 「환경친화적 자동차의 개발 및 보급촉진에 관한 법률」 제2조제2호의 환경친화적자동차는 혼잡통행료의 100분의 50 이상을 감면하되, 구체적인 감면율은 조례로 정한다. <신설 2011.5.19>

⑤ 제1항과 제2항에 따른 혼잡통행료의 기본적인 부과기준과 부과방법 등은 국토교통부령으로 정하고, 혼잡통행료의 부과시간대, 부과대상 자동차의 종류ㆍ용도 등 시행을 위하여 필요한 사항은 조례로 정한다. <개정 2011.5.19, 2013.3.23, 2020.6.9, 2023.8.16>
