도로법 제90조(부대공사의 비용)

① 부대공사의 비용은 부대공사를 실시하기 위한 도로에 대한 도로점용허가(국가 또는 지방자치단체가 제107조에 따라 도로관리청과 협의하거나 도로관리청의 승인을 받고 도로점용을 하는 경우를 포함한다)에 특별한 조건이 있는 경우 외에는 그 부대공사가 필요하게 된 범위에서 이 법에 따라 도로에 관한 비용을 부담하여야 할 자가 그 전부 또는 일부를 부담한다. <개정 2020.6.9>

② 제1항에도 불구하고 제68조제3호에 따라 점용료를 감면받은 자는 도로관리청(제112조에 따라 고속국도에 대한 국토교통부장관의 권한을 대행하는 한국도로공사와 민자도로 관리자를 포함한다)이 도로공사를 시행하는 경우 해당 도로 점용으로 인하여 필요하게 된 타공사의 비용 전부를 부담하여야 한다.

③ 부대공사가 타공사 또는 타행위로 인하여 필요하게 된 경우 그 비용에 관하여는 제91조제1항 및 제2항을 준용한다.
