Enforcement Decree of the Road Act, Article 50-2 (Delegation of Work on Preparing Road Ledgers, etc.)
① 법 제56조제2항에서 "도로대장의 변경을 수반하는 도로공사 등 대통령령으로 정하는 도로공사"란 도로대장의 변경을 수반하는 다음 각 호의 도로공사를 말한다.
(1) The term "road works prescribed by Presidential Decree, such as road works involving changes to road ledgers" in Article 56 (2) of the Act means the following road works involving changes to road ledgers:
1. 법 제32조제1항 및 제2항에 따라 상급도로관리청이 시행하는 도로공사
1. Road works carried out by a superior road management authority under Article 32 (1) and (2) of the Act;
2. 법 제33조제1항에 따라 타공작물의 관리자가 시행하는 도로공사
2. Road works carried out by the manager of another structure under Article 33 (1) of the Act;
3. 법 제35조제1항에 따라 타공사의 시행자나 타행위를 한 자가 시행하는 도로공사
3. Road works carried out by the implementer of other works or the person who performed other acts under Article 35 (1) of the Act;
4. 법 제36조제1항에 따라 도로관리청이 아닌 자가 시행하는 도로공사
4. Road works carried out by a person other than a road management authority under Article 36 (1) of the Act;
5. 법 제37조에 따라 공공단체 또는 사인이 시행하는 도로공사
5. Road works carried out by a public body or private person under Article 37 of the Act.
② 법 제56조제2항에 따라 도로대장의 작성에 관한 업무를 대행하는 자는 같은 조 제3항에 따라 도로대장을 도로관리청에 제출하는 경우 법 제56조의2제1항에 따른 도로대장 통합관리체계(이하 "도로대장 통합관리체계"라 한다)를 통해 제출해야 한다. 다만, 해당 도로대장의 정보의 형태 등으로 인해 도로대장 통합관리체계를 통한 제출이 어렵다고 도로관리청이 인정하는 경우에는 도로관리청이 제시하는 방법에 따라 제출할 수 있다.
(2) A person who handles the work of preparing road ledgers on behalf of another under Article 56 (2) of the Act shall, when submitting a road ledger to the road management authority under paragraph (3) of the same Article, submit it through the road ledger integrated management system under Article 56-2 (1) of the Act (hereinafter referred to as "road ledger integrated management system"). However, where the road management authority recognizes that submission through the road ledger integrated management system is difficult owing to the form of the information in the road ledger or the like, it may be submitted by the method indicated by the road management authority.
③ 도로관리청은 법 제56조제4항에 따라 도로대장을 국토교통부장관에게 제출하는 경우 도로대장 통합관리체계를 통해 제출해야 한다. 다만, 해당 도로대장의 정보의 형태 등으로 인해 도로대장 통합관리체계를 통한 제출이 어렵다고 국토교통부장관이 인정하는 경우에는 국토교통부장관이 제시하는 방법에 따라 제출할 수 있다.
(3) When submitting a road ledger to the Minister of Land, Infrastructure and Transport under Article 56 (4) of the Act, a road management authority shall submit it through the road ledger integrated management system. However, where the Minister of Land, Infrastructure and Transport recognizes that submission through the road ledger integrated management system is difficult owing to the form of the information in the road ledger or the like, it may be submitted by the method indicated by the Minister.
