댐 주변지역 친환경 보전 및 활용에 관한 특별법 제16조(「국토의 계획 및 이용에 관한 법률」에 관한 특례)

① 댐 친환경 활용 계획 수립 시 「국토의 계획 및 이용에 관한 법률」 제27조제3항에 따른 토지적성평가가 필요한 경우 대통령령으로 정하는 별도의 보전대책이 수립된 때에는 평가지표 및 평가기준을 달리하여 평가할 수 있다.

② 댐 친환경 활용 계획 수립 시 「국토의 계획 및 이용에 관한 법률」 제76조에도 불구하고 대통령령으로 정하는 바에 따라 관리지역 안에서의 건축제한 등을 달리 정할 수 있다. 다만, 건축제한 등에 관한 특례는 댐 친환경 활용 계획에 수질오염 저감시설을 설치하는 대책을 포함한 경우에 한정한다.
