Enforcement Decree of the Act on Dam Construction, Management, and Support for Surrounding Areas, etc., Article 4 (Detailed Dam Management Implementation Plan)
① 법 제4조의2제1항에 따라 법 제3조제2항 각 호의 댐을 관리하는 자가 수립해야 하는 관할 댐에 대한 댐관리세부시행계획(이하 "댐관리세부시행계획"이라 한다)에는 다음 각 호의 사항이 포함되어야 한다. <개정 2025.10.1>
(1) The detailed dam management implementation plan for dams under jurisdiction (hereinafter referred to as the "detailed dam management implementation plan") that a person managing a dam under any subparagraph of Article 3 (2) of the Act must formulate under Article 4-2 (1) of the Act shall include the following:
1. 댐관리세부시행계획의 목적 및 추진방향
1. The purpose and promotion direction of the detailed dam management implementation plan;
2. 댐관리세부시행계획의 추진여건 분석
2. An analysis of the conditions for promoting the detailed dam management implementation plan;
3. 관할 댐의 시설물 관리계획
3. A facility management plan for dams under jurisdiction;
4. 관할 댐의 저수(貯水) 운영계획
4. A water storage operation plan for dams under jurisdiction;
5. 관할 댐과 그 주변지역의 보전 및 지속가능하고 친환경적인 이용에 관한 사항(법 제3조제2항제1호의 댐의 경우로 한정한다)
5. Matters concerning the conservation and sustainable and eco-friendly use of dams under jurisdiction and their surrounding areas (limited to dams under Article 3 (2) 1 of the Act);
6. 「지속가능한 기반시설 관리 기본법 시행령」 제4조제1항 각 호의 사항
6. The matters in the subparagraphs of Article 4 (1) of the Enforcement Decree of the Framework Act on Sustainable Management of Infrastructure;
7. 관할 댐 시설의 스마트관리 및 정보화에 관한 사항
7. Matters concerning smart management and informatization of the facilities of dams under jurisdiction;
8. 그 밖에 관할 댐의 효율적인 운영ㆍ관리에 필요하다고 기후에너지환경부장관이 정하여 고시하는 사항
8. Other matters determined and publicly notified by the Minister of Climate, Energy and Environment as necessary for the efficient operation and management of dams under jurisdiction.
② 법 제4조의2제2항 단서 및 같은 조 제3항 단서에서 "대통령령으로 정하는 경미한 사항을 변경하려는 경우"란 각각 다음 각 호의 경우를 말한다.
(2) The phrase "cases of amending minor matters prescribed by Presidential Decree" in the proviso of Article 4-2 (2) and the proviso of paragraph (3) of the same Article means the following cases, respectively:
1. 댐관리세부시행계획의 목적 및 추진방향에 영향을 미치지 않는 사항으로서 그 변경 근거가 분명한 사항을 변경하려는 경우
1. Where a matter that does not affect the purpose and promotion direction of the detailed dam management implementation plan and for which the grounds for amendment are clear is to be amended;
2. 법령의 제정ㆍ개정 또는 폐지에 따라 그 내용을 반영하기 위하여 변경하려는 경우
2. Where an amendment is made to reflect the enactment, amendment, or repeal of statutes;
3. 계산착오, 오기(誤記), 누락, 그 밖에 이에 준하는 명백한 오류를 수정하려는 경우
3. Where a calculation error, clerical error, omission, or other equivalent obvious error is to be corrected.
③ 법 제3조제2항 각 호의 댐을 관리하는 자는 법 제4조의2제1항부터 제3항까지의 규정에 따라 댐관리세부시행계획을 수립하거나 변경한 경우에는 다음 각 호의 구분에 따른 사항을 일간신문, 관보ㆍ공보, 해당 기관의 인터넷 홈페이지나 그 밖의 효과적인 방법으로 공개해야 한다.
(3) Where a person managing a dam under any subparagraph of Article 3 (2) of the Act has formulated or amended the detailed dam management implementation plan under Article 4-2 (1) through (3) of the Act, the person shall make public the following, as classified below, through a daily newspaper, the official gazette or bulletin, the website of the relevant agency, or another effective method:
1. 댐관리세부시행계획을 수립한 경우에는 다음 각 목의 사항
1. Where the detailed dam management implementation plan has been formulated, the following:
가. 제1항 각 호의 사항
(a) The matters in the subparagraphs of paragraph (1);
나. 댐관리세부시행계획의 열람에 관한 사항
(b) Matters concerning inspection of the detailed dam management implementation plan.
2. 댐관리세부시행계획을 변경한 경우에는 다음 각 목의 사항
2. Where the detailed dam management implementation plan has been amended, the following:
가. 댐관리세부시행계획의 변경목적
(a) The purpose of amending the detailed dam management implementation plan;
나. 댐관리세부시행계획의 변경사항
(b) The amendments to the detailed dam management implementation plan;
다. 변경된 댐관리세부시행계획의 열람에 관한 사항
(c) Matters concerning inspection of the amended detailed dam management implementation plan.
④ 제1항부터 제3항까지에서 규정한 사항 외에 댐관리세부시행계획의 수립ㆍ변경 절차 등에 필요한 사항은 기후에너지환경부장관이 정하여 고시한다. <개정 2025.10.1>
(4) Other than the matters prescribed in paragraphs (1) through (3), matters necessary for the procedures for formulating and amending the detailed dam management implementation plan shall be determined and publicly notified by the Minister of Climate, Energy and Environment.
