농업협동조합의 구조개선에 관한 법률 제11조(기금의 설치ㆍ운용)
Act on the Structural Improvement of Agricultural Cooperatives, Article 11 (Establishment and Operation of the Fund)
① 신용사업을 하는 조합이 파산 등의 사유로 예금등채권을 지급할 수 없는 상황에 대처하기 위하여 예금등채권에 대한 보험제도를 효율적으로 운영함으로써 예금자등의 예금등채권의 환급을 보장하고 조합의 건전한 육성을 도모하기 위하여 중앙회에 상호금융예금자보호기금을 설치ㆍ운용한다. <개정 2011.3.31, 2020.5.26>
(1) To cope with situations where an association engaged in credit business cannot pay claims on deposits, etc. due to bankruptcy or other grounds, the Mutual Finance Depositor Protection Fund shall be established and operated at the National Federation in order to guarantee the refund of claims on deposits, etc. of depositors, etc. and to promote the sound development of associations by efficiently operating an insurance system for claims on deposits, etc.
② 기금은 다음 각 호의 재원(財源)을 그 수입으로 한다. <개정 2011.3.31, 2014.3.11>
(2) The revenue of the fund shall consist of the following financial resources:
1. 조합이 납입한 보험료
1. Insurance premiums paid by associations;
2. 정부의 출연금
2. Government contributions;
3. 중앙회의 출연금
3. Contributions from the National Federation;
4. 정부, 「한국은행법」에 따른 한국은행, 중앙회, 농협은행 또는 금융기관으로부터의 차입금
4. Borrowings from the Government, the Bank of Korea under the Bank of Korea Act, the National Federation, NongHyup Bank, or financial institutions;
5. 제6항에 따라 상호금융예금자보호기금채권(이하 "기금채"라 한다)을 발행하여 조성한 자금
5. Funds raised by issuing Mutual Finance Depositor Protection Fund bonds (hereinafter referred to as "fund bonds") under paragraph (6);
6. 관리기관이 매입한 예금등채권을 회수한 자금
6. Funds recovered from claims on deposits, etc. purchased by the managing institution;
7. 제25조 또는 제26조에 따라 지원한 자금을 회수한 자금
7. Funds recovered from funds provided as support under Article 25 or 26;
8. 제29조에 따라 설립된 농업협동조합자산관리회사에 제31조제2항에 따라 빌려 준 자금을 회수한 자금
8. Funds recovered from funds lent under Article 31 (2) to the Agricultural Cooperative Asset Management Company established under Article 29;
9. 기금의 운용수익과 그 밖의 수입금
9. Operating profits of the fund and other revenue.
③ 기금은 다음 각 호의 용도에만 사용할 수 있다. <개정 2020.5.26>
(3) The fund may be used only for the following purposes:
1. 제17조에 따른 보험금의 지급
1. Payment of insurance money under Article 17;
2. 제2항제4호의 차입금 및 기금채의 원리금 상환
2. Repayment of principal and interest on borrowings under paragraph (2) 4 and fund bonds;
3. 제19조제2항에 따른 예금등채권의 매입
3. Purchase of claims on deposits, etc. under Article 19 (2);
5. 제31조제3항에 따른 관리회사의 부실자산 매입에 필요한 자금의 대여
5. Lending of funds necessary for the management company's purchase of non-performing assets under Article 31 (3);
6. 그 밖에 기금의 운용ㆍ관리에 필요한 경비
6. Other expenses necessary for the operation and management of the fund.
④ 기금의 여유자금은 다음 각 호의 방법으로 운용할 수 있다.
(4) Surplus funds of the fund may be managed by the following methods:
1. 국채, 공채, 그 밖에 기금관리위원회가 지정하는 유가증권의 매입
1. Purchase of government bonds, public bonds, and other securities designated by the Fund Management Committee;
2. 기금관리위원회가 지정하는 금융기관에의 예치 또는 단기대출
2. Deposits or short-term loans with financial institutions designated by the Fund Management Committee;
3. 그 밖에 기금관리위원회가 정하는 방법
3. Other methods determined by the Fund Management Committee.
⑤ 제2항제4호에 따른 자금을 차입할 때에는 정부는 그 원리금의 상환을 보증할 수 있다.
(5) When borrowing funds under paragraph (2) 4, the Government may guarantee repayment of principal and interest.
⑥ 관리기관은 기금의 부담으로 기금채를 발행할 수 있다. 이 경우 농협법 제153조제5항ㆍ제6항 및 제154조부터 제157조까지의 규정을 준용한다.
(6) The managing institution may issue fund bonds at the expense of the fund. In such cases, Article 153 (5) and (6) and Articles 154 through 157 of the Cooperatives Act shall apply mutatis mutandis.
⑦ 기금채는 「자본시장과 금융투자업에 관한 법률」 제4조제3항에 따른 특수채증권으로 본다.
(7) Fund bonds shall be deemed special bonds under Article 4 (3) of the Financial Investment Services and Capital Markets Act.
⑧ 기금채의 발행ㆍ모집 등에 필요한 사항은 대통령령으로 정한다.
(8) Matters necessary for the issuance and solicitation, etc. of fund bonds shall be prescribed by Presidential Decree.
