농어촌마을 주거환경 개선 및 리모델링 촉진을 위한 특별법 제26조(소유자의 확인이 곤란한 농어촌주택 등에 대한 처분)

① 사업시행자는 정비사업을 시행할 때 제11조제2항에 따른 고시일 현재 건축물 또는 토지의 소유자의 소재확인이 현저히 곤란한 경우에는 전국적으로 배포되는 둘 이상의 일간신문에 2회 이상 공고하고, 그 공고한 날부터 30일 이상이 지난 때에는 그 건축물 또는 토지의 감정평가액에 해당하는 금액을 법원에 공탁하고 정비사업을 시행할 수 있다. <개정 2020.2.11>

② 조합이 정비사업을 시행할 때 조합 설립의 인가일 현재 조합원 전체의 공동소유인 토지 또는 건축물에 대하여는 조합 소유의 토지 또는 건축물로 본다. <개정 2020.2.11>

③ 제2항에 따라 조합 소유로 보는 토지 또는 건축물의 처분에 관한 사항은 제28조에 따른 관리처분계획에 명시하여야 한다.

④ 제1항에 따른 토지 또는 건축물의 감정평가액은 「감정평가 및 감정평가사에 관한 법률」 제2조에 따른 감정평가법인등 2인 이상이 평가한 금액을 산술평균하여 산정한다. <개정 2016.1.19, 2020.4.7>
