Enforcement Decree of the Special Act on Health and Medical Services in Rural and Fishing Villages, etc., Article 17 (Processing of Sensitive Information and Unique Identification Information)
① 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보(제5호의 사무로 한정한다), 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보(제1호, 제4호부터 제6호까지 및 제8호의 사무로 한정한다), 같은 영 제19조제1호에 따른 주민등록번호가 포함된 자료를 처리할 수 있다. <개정 2022.12.20>
(1) Where unavoidable for performing the following duties, the Minister of Health and Welfare, a Mayor/Do Governor, or the head of a Si/Gun/Gu may process data containing information on health under Article 23 of the Personal Information Protection Act (limited to the duties under subparagraph 5), information corresponding to criminal history data under subparagraph 2 of Article 18 of the Enforcement Decree of the same Act (limited to the duties under subparagraphs 1, 4 through 6, and 8), and resident registration numbers under subparagraph 1 of Article 19 of the same Decree:
1. 법 제5조에 따른 종사명령 등에 관한 사무
1. Duties concerning orders for engagement under Article 5 of the Act, etc.;
2. 법 제6조 및 제6조의2에 따른 근무지역 등의 변경 및 파견근무에 관한 사무
2. Duties concerning changes of work areas, etc. and dispatched work under Articles 6 and 6-2 of the Act;
3. 법 제7조제3항에 따른 명단 통보에 관한 사무
3. Duties concerning notification of the roster under Article 7 (3) of the Act;
4. 법 제8조 및 제9조에 따른 직장 이탈 금지 등 복무에 관한 사무
4. Duties concerning service, such as the prohibition of leaving one's post, under Articles 8 and 9 of the Act;
5. 법 제9조의2에 따른 신분 상실 및 박탈에 관한 사무
5. Duties concerning loss and deprivation of status under Article 9-2 of the Act;
6. 법 제10조에 따른 신분조치 통보에 관한 사무
6. Duties concerning notification of status measures under Article 10 of the Act;
7. 법 제11조에 따른 보수 등의 지급에 관한 사무
7. Duties concerning payment of remuneration, etc. under Article 11 of the Act;
8. 법 제14조에 따른 복무 감독에 관한 사무
8. Duties concerning supervision of service under Article 14 of the Act; and

② 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. 다만, 제3호의 사무의 경우에는 「개인정보 보호법」 제23조에 따른 건강에 관한 정보는 제외한다. <개정 2022.12.20>
(2) Where unavoidable for performing the following duties, the Minister of Health and Welfare, a Mayor/Do Governor, or the head of a Si/Gun/Gu may process data containing information on health under Article 23 of the Personal Information Protection Act and resident registration numbers or foreigner registration numbers under subparagraph 1 or 4 of Article 19 of the Enforcement Decree of the same Act. However, in the case of the duties under subparagraph 3, information on health under Article 23 of the Personal Information Protection Act is excluded:
1. 법 제16조제2항에 따른 직무교육에 관한 사무
1. Duties concerning job training under Article 16 (2) of the Act;
2. 법 제17조제1항에 따른 보건진료 전담공무원의 임용에 관한 사무
2. Duties concerning the appointment of community health practitioner public officials under Article 17 (1) of the Act;
3. 법 제18조제2항에 따른 보건진료 전담공무원의 보수교육에 관한 사무
3. Duties concerning continuing education of community health practitioner public officials under Article 18 (2) of the Act; and
4. 법 제19조에 따른 보건진료 전담공무원의 의료행위에 관한 사무
4. Duties concerning the medical practices of community health practitioner public officials under Article 19 of the Act.
