농약관리법 제23조의6(위원의 제척ㆍ회피ㆍ기피)

① 조정위원회의 위원은 다음 각 호의 어느 하나에 해당하는 경우에는 해당 분쟁사건(이하 "사건"이라 한다)에서 제척(除斥)된다.

② 조정위원회의 위원에게 제척의 사유가 있으면 조정위원회는 직권 또는 당사자의 신청에 따라 제척의 결정을 한다.

(2) Where웨어 a어 member멤버 of어^v브 the^ð더 Mediation미디에이션 Committee커미티 has해즈 grounds그^r라운즈 for^f포 exclusion,익스클루전 the^ð더 Mediation미디에이션 Committee커미티 shall섈 decide디사이드 on안 exclusion익스클루전 ex엑스 officio어^f피시오 or오 upon어판 application애플러케이션 by바이 a어 party.파티

③ 위원은 제1항 또는 제4항의 사유에 해당할 때에는 스스로 그 사건의 직무집행을 회피할 수 있다.

④ 당사자는 위원에게 공정한 직무집행을 기대하기 어려운 사정이 있는 경우에는 조정위원회에 기피신청을 할 수 있으며, 조정위원회는 기피신청이 타당하다고 인정하면 기피의 결정을 한다.

⑤ 조정위원회는 제4항에 따른 기피신청을 받으면 그 신청에 대한 결정을 할 때까지 조정절차를 중지하여야 한다.
