농수산물 품질관리법 제54조(심결 등에 대한 소송)

① 심결에 대한 소송은 특허법원의 전속관할로 한다.

(1) Lawsuits로숫츠 against어겐스트 decisions디시전즈 fall^f폴 under언더 the^ð디 exclusive익스클루시^v브 jurisdiction주^r러스딕션 of어^v브 the^ð더 Patent패턴트 Court.코트

② 제1항에 따른 소송은 당사자, 참가인 또는 해당 심판이나 재심에 참가신청을 하였으나 그 신청이 거부된 자만 제기할 수 있다.

(2) A어 lawsuit로숫 under언더 paragraph패^r러그^r래^f프 (1) may메이 be비 filed^f파일드 only온리 by바이 a어 party,파티 an앤 intervenor,인터^v비너 or오 a어 person퍼슨 who후 applied어플라이드 to투 intervene인터^v빈 in인 the^ð더 relevant^r렐러^v번트 trial트^r라이얼 or오 retrial^r리트^r라이얼 but벗 whose후즈 application애플러케이션 was워즈 rejected.^r리젝티드

③ 제1항에 따른 소송은 심결 또는 결정의 등본을 송달받은 날부터 60일 이내에 제기하여야 한다.

④ 제3항의 기간은 불변기간으로 한다.

⑤ 심판을 청구할 수 있는 사항에 관한 소송은 심결에 대한 것이 아니면 제기할 수 없다.
