농수산물 유통 및 가격안정에 관한 법률 제78조의2(도매시장거래 분쟁조정위원회의 설치 등)

① 도매시장 내 농수산물의 거래 당사자 간의 분쟁에 관한 사항을 조정하기 위하여 도매시장 개설자 소속으로 도매시장거래 분쟁조정위원회(이하 "조정위원회"라 한다)를 두어야 한다. <개정 2018.12.31, 2024.1.23>

② 조정위원회는 당사자의 한쪽 또는 양쪽의 신청에 의하여 다음 각 호의 분쟁을 심의ㆍ조정한다.

(2) The^ð더 Mediation미디에이션 Committee커미티 shall섈 deliberate딜리버^r럿 and앤드 mediate미디에잇 the^ð더 following^f팔로잉 disputes디스퓻츠 upon어판 application애플러케이션 by바이 one원 or오 both보우^θ스 parties:파티즈

③ 중앙도매시장 개설자 소속 조정위원회 위원 중 3분의 1 이상은 농림축산식품부장관 또는 해양수산부장관이 추천하는 위원이어야 한다. <개정 2024.1.23>

④ 조정위원회는 분쟁에 대한 심의ㆍ조정 전 책임 소재의 판단, 손실지원의 수준 권고ㆍ제시 등을 위하여 분쟁조정관을 둘 수 있다. <신설 2024.1.23>

⑤ 도매시장 개설자는 조정위원회(분쟁조정관을 포함한다)의 차년도 운영계획, 전년도 개최실적, 전년도 분쟁 조정 사항 등을 농림축산식품부장관 또는 해양수산부장관에게 매년 보고하여야 한다. <신설 2024.1.23>

⑥ 조정위원회의 구성ㆍ운영 및 제4항에 따른 분쟁조정관의 임명ㆍ위촉자격ㆍ운영에 필요한 사항은 대통령령으로 정한다. <신설 2024.1.23>
