Inland Water Fisheries Act, Article 10 (Order of Priority)

① 제6조 및 제9조에 따른 어업의 면허 및 허가는 다음 각 호의 우선순위에 따른다. <개정 2019.8.27>

1. 어업의 면허 및 허가를 받으려는 수면이 있는 지역 어업인의 공동이익을 위하여 조직된 내수면어업계(內水面漁業契), 내수면과 관련된 법인 및 단체

② 제1항에도 불구하고 지역 어업여건 등을 고려하여 제9조에 따른 허가어업의 우선순위를 해당 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ구(자치구를 말하며, 서울특별시가 관할하는 한강의 경우에는 한강 관리에 관한 업무를 관장하는 기관을 말한다. 이하 같다)의 조례(서울특별시가 관할하는 한강의 경우에는 서울특별시의 조례를 말한다. 이하 같다)로 정할 수 있다. <개정 2017.3.21>

③ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항 및 제2항에 따라 우선순위를 정할 때 다음 각 호의 어느 하나에 해당하는 자는 우선순위에서 배제할 수 있다. 이 경우 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ구에 설치된 내수면어업조정협의회의 심의를 거쳐야 한다. <개정 2017.3.21>

1. 어업의 면허 및 허가를 받으려는 수면에서 이 법 또는 제22조에 따라 준용되는 「수산업법」 및 「수산자원관리법」에 따른 명령ㆍ처분 또는 그 제한이나 조건을 위반하여 행정처분을 받은 자

④ 제3항 각 호 외의 부분 후단에 따른 내수면어업조정협의회는 내수면어업인의 대표와 내수면어업에 관한 학식과 경험이 풍부한 사람으로 구성한다. 이 경우 내수면어업조정협의회의 구성과 운영 등에 필요한 사항은 해당 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ구의 조례로 정한다. <개정 2017.3.21>

⑤ 제4항에도 불구하고 「수산업법」 제95조에 따른 시ㆍ군ㆍ구수산조정위원회(특별자치시 및 특별자치도의 경우 시ㆍ도수산조정위원회를 말한다. 이하 같다)를 설치ㆍ운영 중인 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ구는 시ㆍ군ㆍ구수산조정위원회로 하여금 내수면어업조정협의회의 기능을 수행하게 할 수 있다. <개정 2017.3.21, 2022.1.11>
