기업 활력 제고를 위한 특별법 제33조(기업 등 제안방식에 의한 행정규제 개선의 요청)

① 신청기업 및 승인기업은 대통령령으로 정하는 바에 따라 주무부처의 장에게 해당 사업분야에 대한 행정규제(「행정규제기본법」 제2조제1항제1호에 따른 행정규제를 말한다. 이하 같다) 개선을 요청할 수 있다. 이 경우 신청기업 및 승인기업은 대통령령으로 정하는 방법에 따라 행정규제 개선이 필요한 사항 및 행정규제 개선 시 발생가능한 부작용에 대한 보완방안 등에 관한 사항을 제출하여야 한다.

② 제1항의 행정규제 개선 요청을 받은 주무부처의 장은 제32조제2항 각 호를 준용하여 요청사항을 처리하여야 한다. 이 경우 제32조제2항제1호와 제2호의 "법령등에 관한 해석 및 적용 여부"를 각각 "행정규제 개선의 가능 여부"로 본다.

③ 제36조제1항제2호의2에 따라 이행 관리 업무의 위탁을 받은 기관이 제11조제8항의 조사과정에서 승인기업의 사업재편 이행을 저해하는 행정규제를 발견한 경우 승인기업을 대신하여 제1항의 행정규제 개선을 요청할 수 있다. <신설 2024.1.16>
