기업 활력 제고를 위한 특별법 제32조(법령등의 해석 및 적용의 확인)

1. 요청사항이 주무부처 소관 법령등에 해당하는 경우: 주무부처의 장은 요청받은 날부터 최대 60일 이내에서 대통령령으로 정하는 기간 내에 법령등에 관한 해석 및 적용 여부를 해당 요청기업에게 통보하여야 한다.

2. 요청사항이 주무부처 외의 관계기관의 소관 법령등에 해당하는 경우: 주무부처의 장은 지체 없이 관계기관의 장에게 요청사항을 통보하고, 요청을 받은 관계기관의 장은 통보받은 날부터 최대 60일 이내에서 대통령령으로 정하는 기간 내에 법령등에 관한 해석 및 적용 여부를 해당 주무부처의 장에게 통보하여야 한다. 이 경우 해당 주무부처의 장은 해당 기업에게 지체 없이 그 결과를 통보하여야 한다.

3. 요청사항에 관한 법령등의 소관 부처가 둘 이상인 경우: 요청을 받은 주무부처의 장은 다른 소관 주무부처의 장과 사전협의를 거친 이후에 제1호 또는 제2호의 절차를 진행하여야 한다.
