기업도시개발 특별법 제35조(사립학교의 설립에 관한 특례)

① 시행자가 기업도시의 특성에 맞는 인력 양성과 교육 여건의 개선을 위하여 학교를 설립하려는 경우에는 개발계획과 실시계획에 학교설립계획을 포함하여 작성하여야 한다.

② 국토교통부장관은 제1항에 따른 학교설립계획이 포함되어 있는 개발계획 또는 실시계획을 승인하려는 경우에는 미리 교육부장관 또는 교육감과 협의하여야 한다. <개정 2013.3.23>

③ 교육감은 시행자가 제2항에 따른 협의를 거쳐 승인된 개발계획과 실시계획에 포함된 학교시설사업을 시행하기 위하여 「학교시설사업 촉진법」 제4조에 따라 학교시설사업 시행계획의 승인신청을 한 경우에 이를 검토하여 승인하여야 한다.

④ 「초ㆍ중등교육법」 제4조제2항 및 「고등교육법」 제4조에 따라 제1항부터 제3항까지의 학교에 대한 설립인가를 신청할 때에는 「사립학교법」 제3조에 따른 학교법인을 설립한 후 학교법인이 설립인가를 신청하여야 한다.
