① 다음 각 호의 어느 하나에 해당하는 자에게는 이 법을 적용하지 아니한다.

② 외국의 법령에 따라 설립되어 외국에서 금융업을 영위하는 자(이하 "외국금융회사"라 한다)의 국내지점에 대해서는 제5조, 제7조, 제4장 및 제7장을 적용하며, 이 경우 외국금융회사의 국내지점의 대표자와 그 밖에 대통령령으로 정하는 사람은 이 법에 따른 금융회사의 임원으로 본다.

③ 자산규모, 영위하는 금융업무 등을 고려하여 대통령령으로 정하는 금융회사에 대해서는 다음 각 호의 사항을 적용하지 아니한다. <개정 2024.1.2>
