Act on Corporate Governance of Financial Companies, Article 26 (Qualification Requirements for Compliance Officers)

① 준법감시인은 다음 각 호의 요건을 모두 충족한 사람이어야 한다. <개정 2015.12.22, 2025.10.1>

1. 최근 5년간 이 법 또는 금융관계법령을 위반하여 금융위원회 또는 금융감독원(「금융위원회의 설치 등에 관한 법률」에 따른 금융감독원을 말한다. 이하 같다)의 원장(이하 "금융감독원장"이라 한다), 그 밖에 대통령령으로 정하는 기관으로부터 제35조제1항 각 호 및 제2항 각 호에 규정된 조치 중 문책경고 또는 감봉요구 이상에 해당하는 조치를 받은 사실이 없을 것

2. 다음 각 목의 어느 하나에 해당하는 사람. 다만, 다음 각 목(라목 후단의 경우는 제외한다)의 어느 하나에 해당하는 사람으로서 라목 전단에서 규정한 기관에서 퇴임하거나 퇴직한 후 5년이 지나지 아니한 사람은 제외한다.

가. 「금융위원회의 설치 등에 관한 법률」 제38조에 따른 검사 대상 기관(이에 상당하는 외국금융회사를 포함한다)에서 10년 이상 근무한 사람

나. 금융 관련 분야의 석사학위 이상의 학위소지자로서 연구기관 또는 대학에서 연구원 또는 조교수 이상의 직에 5년 이상 종사한 사람

다. 변호사 또는 공인회계사의 자격을 가진 사람으로서 그 자격과 관련된 업무에 5년 이상 종사한 사람

라. 재정경제부, 금융위원회, 「금융위원회의 설치 등에 관한 법률」 제19조에 따른 증권선물위원회, 감사원, 금융감독원, 한국은행, 「예금자보호법」 제3조에 따라 설립된 예금보험공사(이하 "예금보험공사"라 한다), 그 밖에 금융위원회가 정하여 고시하는 금융 관련 기관에서 7년 이상 근무한 사람. 이 경우 예금보험공사의 직원으로서 「예금자보호법」 제2조제5호에 따른 부실금융회사 또는 같은 조 제6호에 따른 부실우려금융회사와 같은 법 제36조의3에 따른 정리금융회사의 업무 수행을 위하여 필요한 경우에는 7년 이상 근무 중인 사람을 포함한다.

② 준법감시인이 된 사람이 제1항제1호의 요건을 충족하지 못하게 된 경우에는 그 직을 잃는다.
