군인사법 시행령 제53조의2(업무를 대행하는 군인 등)

① 임용권자 또는 임용제청권자는 군인이 다음 각 호의 어느 하나에 해당하는 경우에는 그 군인의 업무를 소속 군인(직무 특성 등을 고려하여 필요하다고 인정하는 경우에는 관련 업무를 담당하는 군무원 또는 일반직공무원을 포함할 수 있다. 이하 이 조에서 같다)에게 대행하도록 명할 수 있다. 다만, 법 제48조제7항에 따라 결원을 보충한 경우에는 그러하지 아니하다. <개정 2025.5.7>

② 임용권자 또는 임용제청권자는 소속 군인에게 「재난 및 안전관리 기본법」 제3조제1호에 따른 재난이나 「자연재해대책법」 제2조제1호에 따른 재해에 대응하기 위하여 출장 또는 파견 중인 군인의 업무를 대행하도록 명할 수 있다.

③ 임용권자 또는 임용제청권자는 제1항 또는 제2항에 따라 업무를 대행하는 소속 군인에게 예산의 범위에서 「공무원수당 등에 관한 규정」에서 정하는 바에 따라 수당을 지급할 수 있다. <개정 2025.5.7>
