군사정전에 관한 협정 체결 이후 납북피해자의 보상 및 지원에 관한 법률 시행령 제9조(정착금의 우선지급 신청)

① 위원회는 북한지역을 벗어난 납북자의 귀환 등을 위하여 부득이 하다고 인정되는 경우, 심의를 거쳐 제8조제1항제1호에 따른 기본금 중 일부를 우선 지급할 수 있다.

② 제1항에 따라 정착금을 우선 지급받으려는 자는 위원회에 별지 제1호서식의 정착금 우선지급신청서 및 신청인의 가족관계기록사항에 관한 증명서와 본인 외의 사람이 대리신청하는 경우에는 납북자와의 관계를 확인할 수 있는 서류 및 별지 제5호서식의 피해위로금등 수령위임장을 첨부하여 제출하여야 한다. 이 경우 대리 신청 및 수령은 그 납북자의 가족으로 한정하되, 가족이 없는 경우에는 위원회가 인정하는 자로 할 수 있다. <개정 2010.11.2, 2013.6.17>

③ 위원회는 제2항에 따른 신청을 받은 경우에는 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 신청인의 주민등록표 등본을 확인하여야 한다. 다만, 신청인이 확인에 동의하지 아니하는 경우에는 그 서류를 첨부하도록 하여야 한다. <개정 2010.5.4, 2010.11.2>
