국제입양에 관한 법률 시행령 제7조(민감정보 및 고유식별정보의 처리)

① 보건복지부장관(법 제32조제1항에 따라 보건복지부장관의 업무를 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호ㆍ제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.

② 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장(자치구의 구청장을 말한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호ㆍ제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.

③ 국가아동권리보장원의 장은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호ㆍ제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2026.5.6>

④ 「국내입양에 관한 특별법」 제13조제3항에 따라 양자가 될 아동을 보호하는 「아동복지법」 제52조제1항제1호ㆍ제2호 및 제4호에 따른 아동양육시설ㆍ아동일시보호시설 및 공동생활가정의 장, 해당 위탁가정을 관리하는 「아동복지법」 제48조의 가정위탁지원센터의 장은 다음 각 호의 사무를 처리하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제19조제1호ㆍ제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
