국유재산법 제51조(소유권의 이전 등)

① 일반재산을 매각하는 경우 해당 매각재산의 소유권 이전은 매각대금이 완납된 후에 하여야 한다.

② 제1항에도 불구하고 제50조제2항에 따라 매각대금을 나누어 내게 하는 경우로서 공익사업의 원활한 시행 등을 위하여 소유권의 이전이 불가피하여 대통령령으로 정하는 경우에는 매각대금이 완납되기 전에 소유권을 이전할 수 있다. 이 경우 저당권 설정 등 채권의 확보를 위하여 필요한 조치를 취하여야 한다.
