국세기본법 시행령 제52조의3(재조사 결과에 따른 처분의 통지 등)

① 처분청은 법 제65조제5항(법 제66조제6항, 제80조의2 및 제81조의15제6항에서 준용하는 경우를 포함한다)에 따른 재조사 결과에 따라 청구의 대상이 된 처분의 취소ㆍ경정을 하거나 필요한 처분을 하였을 때에는 그 처분결과를, 법 제65조제6항에 따라 당초의 처분을 취소ㆍ경정하지 않았을 때에는 그 사실을 지체 없이 서면으로 심사청구인(법 제66조제6항, 제80조의2 및 제81조의15제6항에서 준용하는 경우에는 이의신청인, 심판청구인 또는 과세전적부심사 청구인을 말한다)에게 통지하여야 한다. <개정 2019.2.12, 2023.2.28>

② 법 제65조제6항(법 제66조제6항, 제80조의2 및 제81조의15제6항에서 준용하는 경우를 포함한다)에서 "심사청구인의 주장과 재조사 과정에서 확인한 사실관계가 다른 경우 등 대통령령으로 정하는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <신설 2023.2.28>
