국민건강증진법 시행령 제32조의2(민감정보 및 고유식별정보의 처리)

① 보건복지부장관(제18조의2 및 제32조에 따라 보건복지부장관의 권한을 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.

② 질병관리청장(법 제29조제3항에 따라 질병관리청장의 권한을 위임받은 자를 포함한다)은 법 제16조에 따른 국민건강영양조사에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조제1호에 따른 주민등록번호가 포함된 자료를 처리할 수 있다. <개정 2020.9.11, 2023.9.26>

③ 보건복지부장관(제32조에 따라 보건복지부장관의 업무를 위탁받은 자를 포함한다)은 법 제34조제5항에 따른 교육 또는 금연지원 서비스를 받았는지 여부의 확인 및 과태료 감면 대상자의 정보 관리에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호에 따른 주민등록번호가 포함된 자료를 처리할 수 있다. <신설 2020.6.2>
