국가통합교통체계효율화법 제83조(지능형교통체계 표준인증 및 품질인증 등)

① 국토교통부장관은 지능형교통체계표준의 보급을 촉진하고 품질의 확보 및 향상을 위하여 지능형교통체계 관련 장비ㆍ제품 및 서비스 등을 대상으로 표준인증 및 품질인증을 할 수 있다. <개정 2013.3.23>

(1) To투 promote프^r러모우트 the^ð더 dissemination디세머네이션 of어^v브 intelligent인텔러전트 transport트^r랜스포트 system시스텀 standards스탠더즈 and앤드 secure시큐어 and앤드 improve임프^r루^v브 quality,콸러티 the^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 may메이 conduct칸덕트 standard스탠더드 certification서터^f퍼케이션 and앤드 quality콸러티 certification서터^f퍼케이션 of어^v브 equipment,이큅먼트 products,프^r라덕츠 and앤드 services,서^v버시즈 etc.엣세터^r러 related^r릴레이티드 to투 the^ð디 intelligent인텔러전트 transport트^r랜스포트 system.시스텀

② 국토교통부장관은 제1항에 따른 표준인증 및 품질인증을 하기 위하여 표준인증기관 및 품질인증기관을 지정할 수 있다. <개정 2013.3.23>

(2) The^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 may메이 designate데저그네잇 a어 standard스탠더드 certification서터^f퍼케이션 body바디 and앤드 a어 quality콸러티 certification서터^f퍼케이션 body바디 in인 order오더 to투 conduct칸덕트 the^ð더 standard스탠더드 certification서터^f퍼케이션 and앤드 quality콸러티 certification서터^f퍼케이션 under언더 paragraph패^r러그^r래^f프 (1).

③ 지능형교통체계 관련 장비ㆍ제품 및 서비스 등을 제조 또는 공급하는 자가 표준인증 또는 품질인증을 받으려는 경우에는 국토교통부장관이 고시하는 기준에 따라 제2항에 따른 표준인증기관의 장 또는 품질인증기관의 장이 산정한 수수료를 해당 인증기관의 장에게 내야 한다. <개정 2013.3.23>

④ 표준인증기관 및 품질인증기관은 제3항에 따른 인증 신청을 받은 경우 국토교통부장관이 정하여 고시하는 인증기준에 적합하다고 인정하는 경우에는 인증을 하여야 한다. <개정 2013.3.23>

⑤ 제4항에 따라 표준인증 또는 품질인증을 받은 자는 해당 장비ㆍ제품이나 관련 문서 등에 국토교통부령으로 정하는 바에 따라 표준인증 또는 품질인증을 받은 것임을 나타내는 표시(이하 "인증표시"라 한다)를 하거나 그 사실을 홍보할 수 있다. <개정 2013.3.23>

⑥ 제4항에 따른 표준인증 또는 품질인증을 받은 자가 아니면 해당 장비ㆍ제품이나 관련 문서 등에 인증표시를 하거나 이와 유사한 표시를 하여서는 아니 되며, 이를 위반하여 인증표시를 하거나 이와 유사한 표시를 한 장비ㆍ제품을 판매하거나 판매할 목적으로 진열 또는 홍보하여서는 아니 된다.

(6) A어 person퍼슨 who후 has해즈 not낫 obtained어브테인드 standard스탠더드 certification서터^f퍼케이션 or오 quality콸러티 certification서터^f퍼케이션 under언더 paragraph패^r러그^r래^f프 (4) shall섈 not낫 put풋 a어 certification서터^f퍼케이션 mark마크 or오 a어 similar시멀러 mark마크 on안 the^ð더 relevant^r렐러^v번트 equipment,이큅먼트 products,프^r라덕츠 or오 related^r릴레이티드 documents,다큐먼츠 etc.,엣세터^r러 and앤드 shall섈 not낫 sell,셀 or오 display디스플레이 or오 publicize퍼블리사이즈 for^f포 the^ð더 purpose퍼퍼스 of어^v브 sale,세일 equipment이큅먼트 or오 products프^r라덕츠 bearing베^r링 a어 certification서터^f퍼케이션 mark마크 or오 similar시멀러 mark마크 in인 violation^v바이얼레이션 of어^v브 this^ð디스 provision.프^r러^v비전

⑦ 국토교통부장관은 제6항을 위반한 자에 대하여 해당 장비ㆍ제품 및 서비스 등을 수거ㆍ반품 및 중지하게 하거나, 인증표시를 제거하게 하거나, 해당 인증을 받은 후에 그 표시를 하도록 하는 등 필요한 시정 조치를 명할 수 있다. <개정 2013.3.23>

⑧ 표준인증 및 품질인증의 대상, 절차 및 방법 등에 관하여 필요한 사항은 대통령령으로 정한다.
