Educational Public Officials Act, Article 44-2 (Release from Position)

① 임용권자는 다음 각 호의 어느 하나에 해당하는 자에게는 직위를 부여하지 아니할 수 있다. <개정 2026.8.4>

마. 「아동복지법」 제17조에 따른 금지행위

바. 교육공무원으로서의 품위를 크게 손상하여 그 직위를 유지하는 것이 부적절하다고 판단되는 행위

② 제1항에 따라 직위를 부여하지 아니한 경우 그 사유가 소멸되면 임용권자는 지체 없이 직위를 부여하여야 한다.

③ 임용권자는 제1항제1호에 따라 직위해제된 자에게 3개월의 범위에서 대기를 명한다.

⑤ 교육공무원에 대하여 제1항제1호의 직위해제 사유와 같은 항 제2호부터 제4호까지의 직위해제 사유가 경합(競合)할 때에는 같은 항 제2호부터 제4호까지의 직위해제 처분을 하여야 한다.
