관세법 시행령 제242조(지식재산권등 침해 여부의 확인 등)

①세관장은 수출입신고등이 된 물품 또는 통관우체국에 도착한 물품의 지식재산권등 침해 여부를 판단하기 위하여 필요하다고 인정되는 경우에는 해당 지식재산권등의 권리자로 하여금 지식재산권등에 대한 전문인력 또는 검사시설을 제공하도록 할 수 있다. <개정 2008.2.22, 2011.4.1, 2023.2.28, 2025.2.28>

②세관장은 지식재산권등의 권리자, 수출입신고등을 한 자 또는 우편물의 화주가 지식재산권등의 침해 여부를 판단하기 위하여 법 제235조제3항에 따라 수출입신고등의 사실 또는 통관우체국 도착 사실이 통보된 물품 또는 법 제235조제5항 본문에 따라 통관보류등이 된 물품에 대한 검사 및 견본품의 채취를 요청하면 해당 물품에 관한 영업상의 비밀보호 등 특별한 사유가 없는 한 이를 허용해야 한다. <개정 2008.2.22, 2011.4.1, 2023.2.28, 2025.2.28, 2026.2.27>
