관세법 시행령 제188조(특허보세구역의 설치ㆍ운영에 관한 특허의 신청)

①법 제174조제1항의 규정에 의하여 법 제154조의 규정에 의한 특허보세구역(이하 "특허보세구역"이라 한다)의 설치ㆍ운영에 관한 특허를 받고자 하는 자는 다음 각호의 사항을 기재한 신청서에 재정경제부령이 정하는 서류를 첨부하여 세관장에게 제출하여야 한다. <개정 2008.2.29, 2025.12.30>

②제1항의 규정에 불구하고 특허보세구역 중 보세공장의 설치운영에 관한 특허를 받으려는 자는 다음 각 호의 사항을 기재한 신청서에 사업계획서와 그 구역 및 부근의 도면을 첨부하여 세관장에게 제출하여야 한다. 이 경우 세관장은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 법인 등기사항증명서를 확인하여야 한다. <개정 2001.12.31, 2006.6.12, 2010.5.4, 2010.11.2>

③제1항에 따른 특허를 갱신하려는 자는 다음 각 호의 사항을 적은 신청서에 재정경제부령으로 정하는 서류를 첨부하여 그 기간만료 1개월 전까지 세관장에게 제출하여야 한다. <개정 2008.2.29, 2012.2.2, 2025.12.30>

④ 세관장은 제1항에 따라 특허를 받은 자에게 특허를 갱신받으려면 특허기간이 끝나는 날의 1개월 전까지 특허 갱신을 신청하여야 한다는 사실과 갱신절차를 특허기간이 끝나는 날의 2개월 전까지 휴대폰에 의한 문자전송, 전자메일, 팩스, 전화, 문서 등으로 미리 알려야 한다. <신설 2012.2.2>
