Enforcement Decree of the Customs Act, Article 158-2 (Access to Passenger Reservation Data, etc.)

①세관장은 법 제137조의2제1항에 따라 제공받은 승객예약자료(이하 이 조에서 "승객예약자료"라 한다)를 열람할 수 있는 세관공무원(법 제137조의2제3항에 따라 지정받은 자를 말한다. 이하 이 조에서 같다)에게 관세청장이 정하는 바에 따라 개인식별 고유번호를 부여하는 등의 조치를 하여 권한 없는 자가 승객예약자료를 열람하는 것을 방지하여야 한다.

②세관장은 승객이 입항 또는 출항한 날(이하 이 조에서 "입ㆍ출항일"이라 한다)부터 1월이 경과한 때에는 해당승객의 승객예약자료를 다른 승객의 승객예약자료(승객의 입ㆍ출항일부터 1월이 경과하지 아니한 승객예약자료를 말한다)와 구분하여 관리하여야 한다.

③세관장은 제2항에 따라 구분하여 관리하는 승객예약자료(이하 이 조에서 "보존승객예약자료"라 한다)를 해당승객의 입ㆍ출항일부터 기산하여 3년간 보존할 수 있다. 다만, 다음 각 호의 어느 하나에 해당하는 자에 대한 보존승객예약자료는 5년간 보존할 수 있다. <개정 2012.6.7, 2016.1.6, 2026.2.27>
