관세법 시행령 제122조(폐기물품의 관세환급)

①법 제106조제3항의 규정에 의하여 물품의 폐기의 승인을 얻고자 하는 자는 다음 각호의 사항을 기재한 신청서에 당해 물품의 수입신고필증 또는 이에 갈음하는 세관의 증명서와 당해 물품의 폐기가 부득이한 것을 증빙하는 서류를 첨부하여 세관장에게 제출하여야 한다.

②제1항의 규정에 의하여 승인을 얻어 폐기한 물품에 대하여 법 제106조제3항의 규정에 의하여 관세를 환급받고자 하는 자는 다음 각호의 사항을 기재한 신청서에 제1항의 규정에 의한 폐기승인서를 첨부하여 세관장에게 제출하여야 한다.

③제2항의 규정에 의하여 환급하는 관세액은 그 물품에 대하여 이미 납부한 그 관세액으로 한다. 다만, 제2항제3호의 규정에 의한 잔존물에 대하여는 그 폐기한 때의 당해 잔존물의 성질ㆍ수량 및 가격에 의하여 부과될 관세액을 공제한 금액으로 한다.
