공유재산 및 물품 관리법 제31조(대부기간)

① 일반재산의 대부는 다음 각 호의 구분에 따른 기간을 초과할 수 없다. 다만, 지역경제의 활성화를 위하여 대통령령으로 정하는 경우에는 예외로 한다. <개정 2021.4.20>

② 지방자치단체의 장은 제29조제1항 단서에 따라 수의계약의 방법으로 대부한 경우에는 대부기간이 끝나기 전에 제1항에 따른 대부기간의 범위에서 대부계약을 갱신할 수 있다. 다만, 수의계약으로 대부할 수 있는 경우가 아니면 한 차례만 갱신할 수 있다. <개정 2010.2.4, 2021.4.20>

③ 지방자치단체의 장은 제2항의 적용을 받지 아니하는 자에 대하여도 1회로 한정하여 대부계약을 갱신할 수 있다. 이 경우 갱신하는 대부기간은 제1항에 따른 대부기간을 초과할 수 없다. <개정 2010.2.4, 2014.1.7>

④ 지방자치단체의 장은 대부를 받은 자가 다음 각 호의 어느 하나에 해당하는 경우에는 대부기간을 연장할 수 있다. 이 경우 연장하는 대부기간은 다음 각 호의 사유로 이용하지 못한 기간의 범위로 한다. <개정 2010.2.4, 2022.11.15>

⑤ 제2항 및 제3항에 따라 대부계약을 갱신하려는 자 또는 제4항에 따라 대부기간을 연장받으려는 자는 대부기간이 끝나기 1개월 전에 지방자치단체의 장에게 대부계약의 갱신 또는 대부기간의 연장을 신청하여야 한다. <신설 2010.2.4>
