공유재산 및 물품 관리법 시행령 제85조(은닉된 공유재산의 자진 반환자에 대한 특례)
Enforcement Decree of the Public Property and Commodities Management Act, Article 85 (Special Provisions for Persons Voluntarily Returning Concealed Public Property)
① 법 제85조에 따라 은닉된 공유재산을 지방자치단체에 자진 반환한 자에게 그 공유재산을 매각하는 경우 자진 반환의 원인에 따라 다음 각 호의 구분에 따른 방법으로 분할납부하거나 일정 금액을 뺀 후 한꺼번에 납부하게 할 수 있다. <개정 2014.7.7>
(1) When selling concealed public property to a person who has voluntarily returned it to a local government pursuant to Article 85 of the Act, depending on the cause of voluntary return, installment payment or lump-sum payment after deduction of a certain amount may be required by the following methods according to the following classification:
1. 자진 반환하거나 제소 전 화해로 반환한 경우: 12년 이내의 기간에 걸쳐 분할납부하거나 매각가격에서 80퍼센트를 뺀 금액을 매각대금으로 하여 한꺼번에 납부
1. Where returned voluntarily or returned by pre-suit settlement: Installment payment over a period of up to 12 years, or lump-sum payment of the amount obtained by subtracting 80 percent from the sale price as the sale price;
2. 제1심의 소송 진행 중의 화해 또는 청구의 인낙(認諾)으로 반환한 경우: 10년 이하의 기간에 걸쳐 분할납부하거나 매각가격에서 70퍼센트를 뺀 금액을 매각대금으로 하여 한꺼번에 납부
2. Where returned by settlement or acknowledgment of claim during first-instance litigation: Installment payment over a period of up to 10 years, or lump-sum payment of the amount obtained by subtracting 70 percent from the sale price as the sale price;
3. 항소 제기 전의 항소권의 포기 또는 항소 제기기간의 경과로 인한 항소권 소멸로 반환한 경우: 8년 이내의 기간에 걸쳐 분할납부하거나 매각가격에서 60퍼센트를 뺀 금액을 매각대금으로 하여 한꺼번에 납부
3. Where returned due to waiver of the right to appeal before filing an appeal or extinction of the right to appeal by lapse of the appeal filing period: Installment payment over a period of up to 8 years, or lump-sum payment of the amount obtained by subtracting 60 percent from the sale price as the sale price;
4. 항소의 취하, 항소심의 소송 진행 중의 화해 또는 청구의 인낙으로 반환한 경우: 6년 이내의 기간에 걸쳐 분할납부하거나 매각가격에서 50퍼센트를 뺀 금액을 매각대금으로 하여 한꺼번에 납부
4. Where returned by withdrawal of an appeal, or settlement or acknowledgment of claim during appellate litigation: Installment payment over a period of up to 6 years, or lump-sum payment of the amount obtained by subtracting 50 percent from the sale price as the sale price;
5. 상고 제기 전의 상고권의 포기 또는 상고 제기기간의 경과로 인한 상고권의 소멸로 반환한 경우: 4년 이내의 기간에 걸쳐 분할납부하거나 매각가격의 40퍼센트를 뺀 금액을 매각대금으로 하여 한꺼번에 납부
5. Where returned due to waiver of the right to appeal to the Supreme Court before filing such an appeal or extinction of the right to appeal by lapse of the appeal filing period: Installment payment over a period of up to 4 years, or lump-sum payment of the amount obtained by subtracting 40 percent of the sale price as the sale price;
6. 상고의 취하, 상고심의 소송 진행 중의 화해 또는 청구의 인낙으로 반환한 경우: 2년 이내의 기간에 걸쳐 분할납부하거나 매각가격의 30퍼센트를 뺀 금액을 매각대금으로 하여 한꺼번에 납부
6. Where returned by withdrawal of an appeal to the Supreme Court, or settlement or acknowledgment of claim during litigation at the Supreme Court: Installment payment over a period of up to 2 years, or lump-sum payment of the amount obtained by subtracting 30 percent of the sale price as the sale price.
② 제1항에 따른 자진 반환의 경우에 그 반환일은 반환하려는 은닉된 공유재산의 소유권 이전을 위한 등기신청서의 접수일로 한다.
(2) In the case of voluntary return under paragraph (1), the return date shall be the date of receipt of the registration application for transfer of ownership of the concealed public property to be returned.
