공유재산 및 물품 관리법 시행령 제32조(대부료의 납부기한)

① 공유재산의 대부료는 대부 전에 미리 내야 한다.

② 법 제32조제2항 단서에 따라 연간 대부료가 50만원을 초과하는 경우와 「벤처기업육성에 관한 특별법」에 따른 벤처기업의 경우에는 제1항에도 불구하고 시중은행의 1년 만기 정기예금의 평균 수신금리를 고려하여 행정안전부장관이 정하여 고시하는 이자율을 적용한 이자를 붙여 연 12회의 범위에서 대부료를 분할납부하게 할 수 있다. <개정 2010.8.4, 2013.6.21, 2016.7.12, 2017.7.26, 2020.12.22, 2023.8.22, 2024.7.2>

③ 제1항 및 제2항에도 불구하고 지방자치단체의 조례로 정하는 외국인투자기업의 경우에는 최초로 준공된 건물 등의 준공일부터 60일 이내에 시중은행의 1년 만기 정기예금의 평균 수신금리를 고려하여 행정안전부장관이 정하여 고시하는 이자율을 적용한 이자를 붙여 대부료를 납부하게 할 수 있다. <개정 2013.6.21, 2016.7.12, 2017.7.26>

④ 지방자치단체의 장은 제31조제1항 단서에 따라 기간을 정하여 한시적으로 인하한 요율을 적용한 경우 해당 기간에 납부기한이 도래하는 대부료는 1년(납부기한을 기준으로 하여 남은 대부기간이 1년 미만인 경우에는 그 남은 대부기간)의 범위에서 미루어 내게 할 수 있다. <신설 2020.12.22>

⑤ 법 제32조제3항에 따라 보증금을 예치하게 하거나 지방자치단체를 피보험자로 하는 이행보증보험을 체결하게 하는 경우 그 금액은 연간 대부료의 100분의 50에 해당하는 금액 이하로 한다. <신설 2010.8.4, 2020.12.22>
