공무원 재해보상법 제7조(심의회의 구성 등)
Public Officials Disaster Compensation Act, Article 7 (Composition of the Deliberation Committee)
① 심의회는 위원장 1명을 포함한 100명 이내의 위원으로 구성한다.
(1) The Deliberation Committee shall consist of not more than 100 members, including one chairperson.
② 심의회의 위원장은 위원 중에서 인사혁신처장이 임명 또는 위촉한다.
(2) The chairperson of the Deliberation Committee shall be appointed or commissioned by the Minister of Personnel Management from among the members.
③ 심의회의 당연직 위원은 기획예산처, 행정안전부, 국가보훈부, 고용노동부 및 인사혁신처 소속 4급 이상 공무원 또는 이에 상당하는 공무원으로서 재해보상ㆍ연금ㆍ복지 또는 복무 관련 업무를 담당하는 공무원 중에서 해당 기관의 장이 지명하는 사람으로 하고, 당연직이 아닌 위원은 다음 각 호의 사람 중에서 인사혁신처장이 임명 또는 위촉한다. <개정 2023.3.4, 2025.10.1>
(3) The ex officio members of the Deliberation Committee shall be persons designated by the head of the agency concerned from among public officials of Grade IV or higher, or equivalent, belonging to the Ministry of Planning and Budget, the Ministry of the Interior and Safety, the Ministry of Patriots and Veterans Affairs, the Ministry of Employment and Labor, and the Ministry of Personnel Management, who are in charge of affairs related to disaster compensation, pensions, welfare, or service; and members who are not ex officio shall be appointed or commissioned by the Minister of Personnel Management from among the following persons:
1. 「공무원연금법」에 따른 공무원연금공단(이하 "공단"이라 한다) 소속 임직원 중 해당 기관의 장이 추천하는 사람
1. Persons recommended by the head of the agency concerned from among officers and employees of the Public Officials Pension Service under the Public Officials Pension Act (hereinafter referred to as the "Service");
2. 재해보상ㆍ연금ㆍ복지ㆍ복무 등 인사행정 또는 사회보장 관련 업무에 종사하고 있거나 종사하였던 사람 중에서 4급 이상 공무원 또는 이에 상당하는 공무원으로 재직하고 있거나 재직하였던 사람
2. Persons who are or were public officials of Grade IV or higher, or equivalent, from among persons engaged or formerly engaged in personnel administration or social security-related affairs such as disaster compensation, pensions, welfare, and service;
3. 판사, 검사 또는 변호사로 재직하고 있거나 재직하였던 사람
3. Persons who are or were judges, prosecutors, or attorneys;
5. 그 밖에 재해보상ㆍ연금ㆍ복지ㆍ복무 등 인사행정 및 사회보장 분야에 관한 학식과 경험이 풍부한 사람
5. Other persons with abundant knowledge and experience in the fields of personnel administration and social security such as disaster compensation, pensions, welfare, and service.
④ 위원의 임기는 3년으로 하며, 대통령령으로 정하는 바에 따라 연임할 수 있다. 다만, 당연직 위원 및 제3항제1호의 위원은 그 직(職)에 있는 동안 재임(在任)한다.
(4) The term of office of members shall be three years, and they may be reappointed as prescribed by Presidential Decree. However, ex officio members and members under paragraph (3) 1 shall remain in office while holding their positions.
⑤ 심의회의 회의는 위원장과 위원장이 회의 시마다 지정하는 위원을 포함하여 11명 이상 15명 이하로 구성한다.
(5) Meetings of the Deliberation Committee shall consist of not fewer than 11 and not more than 15 members, including the chairperson and members designated by the chairperson for each meeting.
⑥ 심의회는 심의를 위하여 필요한 경우 다음 각 호의 조치를 할 수 있다.
(6) The Deliberation Committee may take the following measures where necessary for deliberation:
1. 급여 청구인 또는 그 청구인이 지정하는 사람, 관계 공무원 및 그 밖의 이해관계인 등에 대한 출석 요구 및 의견 청취
1. Requiring attendance and hearing the opinions of benefit claimants or persons designated by the claimants, relevant public officials, and other interested persons;
2. 관계 공무원 또는 그 밖에 급여에 관련된 사람ㆍ기관 등에 대한 자료 제출 요구
2. Requiring relevant public officials or other persons and agencies related to benefits to submit data.
⑦ 제1항부터 제6항까지에서 규정한 사항 외에 심의회의 구성 및 운영에 필요한 사항은 대통령령으로 정한다.
(7) Except as provided in paragraphs (1) through (6), matters necessary for the composition and operation of the Deliberation Committee shall be prescribed by Presidential Decree.
