공무원 재해보상법 제57조의2(역학조사)

① 인사혁신처장은 공무상 질병의 발생 원인을 규명하기 위하여 필요하다고 인정할 때에는 공무원이거나 공무원이었던 사람의 질병과 근무환경의 상관관계에 관한 역학조사(이하 "역학조사"라 한다)를 할 수 있다. 이 경우 해당 공무상 질병에 대하여 요양급여나 재해유족급여를 청구한 사람 또는 해당 공무원이 소속되어 있거나 소속되었던 기관장의 요구가 있으면 다음 각 호의 사람을 총리령으로 정하는 바에 따라 역학조사에 참석하게 할 수 있다.

② 제1항에 따른 기관장 및 그 기관의 소속 공무원은 인사혁신처장이 역학조사를 실시하는 경우 적극 협조하여야 하며, 정당한 사유 없이 역학조사를 거부ㆍ방해하거나 기피하여서는 아니 된다.

③ 누구든지 제1항 후단에 따라 역학조사 참석이 허용된 사람의 역학조사 참석을 거부하거나 방해하여서는 아니 된다.

④ 제1항에 따라 역학조사를 하거나 역학조사에 참석하는 자는 역학조사 과정에서 알게 된 비밀을 누설하거나 도용하여서는 아니 된다. 다만, 공무원의 건강장해를 예방하기 위하여 인사혁신처장이 필요하다고 인정하는 경우에는 그러하지 아니하다.

⑤ 인사혁신처장은 역학조사에 필요하면 관계 기관의 장에게 다음 각 호의 정보 또는 자료의 제출을 요청할 수 있다. 이 경우 자료의 제출을 요청받은 기관의 장은 특별한 사유가 없으면 이에 따라야 한다.

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 역학조사의 방법ㆍ대상ㆍ절차, 그 밖에 필요한 사항은 총리령으로 정한다.
