공무원연금법 시행령 제24조(급여사유의 확인 및 급여 등의 심의)
Enforcement Decree of the Public Officials Pension Act, Article 24 (Confirmation of Grounds for Benefits and Deliberation on Benefits, etc.)
법 제29조제1항 단서에서 "제59조에 따른 장해연금 또는 장해일시금, 제63조제3항 및 제4항에 따른 급여제한사유 해당 여부 등 대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다. <개정 2021.6.22>
The "matters prescribed by Presidential Decree, such as disability pension or disability lump sum under Article 59, and whether grounds for restricting benefits under Article 63 (3) and (4) apply" in the proviso of Article 29 (1) of the Act means the following:
1. 법 제42조제1항 단서에 따른 제3자에 대한 손해배상청구권의 전부 또는 일부 행사 여부
1. Whether the right to claim damages against a third party under the proviso of Article 42 (1) of the Act has been exercised in whole or in part;
2. 법 제63조제3항 및 제4항에 따른 급여제한사유 해당 여부
2. Whether grounds for restricting benefits under Article 63 (3) and (4) of the Act apply;
3. 제40조에 따른 장해 상태 해당 여부
3. Whether the state of disability under Article 40 applies;
4. 제54조 및 제56조에 따른 장해등급의 결정 및 개정(改定)
4. Determination and revision of disability grade under Articles 54 and 56;
5. 그 밖에 급여의 결정 또는 지급과 관련하여 인사혁신처장이 정하는 사항
5. Other matters related to the determination or payment of benefits as determined by the Minister of Personnel Management.
