공동주택관리법 시행령 제29조의3(사업주체의 어린이집 등의 임대계약 체결)

① 시장ㆍ군수ㆍ구청장은 입주자대표회의가 구성되기 전에 다음 각 호의 주민공동시설의 임대계약 체결이 필요하다고 인정하는 경우에는 사업주체로 하여금 입주예정자 10분의 3 이상의 서면 동의를 받아 해당 시설의 임대계약을 체결하도록 할 수 있다. <개정 2021.1.5, 2025.4.15>

② 사업주체는 제1항에 따라 임대계약을 체결하려는 경우에는 해당 공동주택단지의 인터넷 홈페이지에 관련 내용을 공고하고 입주예정자에게 개별 통지해야 한다. <개정 2021.1.5>

③ 사업주체는 제1항에 따라 임대계약을 체결하려는 경우에는 관리규약 및 관련 법령의 규정에 따라야 한다. 이 경우 어린이집은 관리규약 중 제19조제1항제21호다목의 사항은 적용하지 않는다. <개정 2021.1.5>
