공공단체등 위탁선거에 관한 법률 제78조(선거관리경비)

① 위탁선거를 위한 다음 각 호의 경비는 해당 위탁단체가 부담하고 선거의 실시에 지장이 없도록 제1호의 경우에는 선거기간개시일 전 60일(보궐선거등의 경우에는 위탁신청을 한 날부터 10일)까지, 제2호부터 제4호까지의 경우에는 위탁관리 결정의 통지를 받은 날(의무위탁선거의 경우에는 위탁신청을 한 날)부터 10일까지 관할위원회에 납부하여야 한다. <개정 2024.1.30>

② 동시조합장선거 및 동시이사장선거에서 제76조에 따른 포상금 지급에 필요한 경비는 해당 조합 또는 금고와 그 중앙회가 균분하여 부담하여야 한다. <개정 2023.8.8>

③ 위탁선거의 관리에 필요한 다음 각 호의 경비는 국가가 부담한다.

④ 중앙선거관리위원회는 위탁기관의 의견을 들어 선거관리경비 산출기준을 정하고 이를 관할위원회에 통지하여야 하며, 관할위원회는 그 산출기준에 따라 경비를 산출하여야 한다.

(4) The^ð더 National내셔늘 Election일렉션 Commission커미션 shall,섈 after애^f프터 hearing히^r링 the^ð디 opinions어피니언즈 of어^v브 the^ð디 entrusting엔트^r러스팅 institutions,인스티투션즈 determine더터먼 the^ð더 standards스탠더즈 for^f포 calculating캘큘레이팅 election일렉션 management매너지먼트 expenses익스펜시즈 and앤드 notify노우터^f파이 the^ð더 competent캄퍼틴트 committee커미티 thereof,^ð데^r러^v브 and앤드 the^ð더 competent캄퍼틴트 committee커미티 shall섈 calculate캘큘레잇 the^ð디 expenses익스펜시즈 according어코딩 to투 the^ð더 standards.스탠더즈

⑤ 관할위원회는 제52조에 따른 결선투표가 실시될 경우 그 선거관리경비를 제4항과 별도로 산출하여야 한다.

⑥ 관할위원회는 제4항에 따라 선거관리경비를 산출하는 때에는 예측할 수 없는 경비 또는 불가피한 사유로 산출기준을 초과하는 경비에 충당하기 위하여 산출한 선거관리경비 총액의 100분의 5 범위에서 부가경비를 계상하여야 한다.

⑦ 제1항에 따른 납부금은 체납처분이나 강제집행의 대상이 되지 아니하며 그 경비의 산출기준, 납부절차와 방법, 집행, 검사, 반환, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다.
