공공단체등 위탁선거에 관한 법률 제76조(위탁선거 위반행위 신고자에 대한 포상금 지급)

① 관할위원회는 위탁선거 위반행위에 대하여 선거관리위원회가 인지하기 전에 그 위반행위의 신고를 한 사람에게 포상금을 지급할 수 있다. <개정 2024.1.30>

② 관할위원회는 제1항에 따라 포상금을 지급한 후 다음 각 호의 어느 하나에 해당하는 사유가 있는 경우에는 그 포상금의 지급결정을 취소한다. <신설 2024.1.30>

③ 관할위원회는 제2항에 따라 포상금의 지급결정을 취소한 때에는 해당 신고자에게 그 취소 사실과 지급받은 포상금에 해당하는 금액을 반환할 것을 통지하여야 하며, 해당 신고자는 통지를 받은 날부터 30일 이내에 그 금액을 해당 관할위원회에 납부하여야 한다. <신설 2024.1.30>

④ 관할위원회는 제3항에 따라 포상금의 반환을 통지받은 해당 신고자가 납부기한까지 반환할 금액을 납부하지 아니한 때에는 해당 신고자의 주소지를 관할하는 세무서장에게 징수를 위탁하고 관할 세무서장이 국세강제징수의 예에 따라 징수한다. <신설 2024.1.30>

⑤ 제3항 또는 제4항에 따라 납부 또는 징수된 금액은 국가에 귀속된다. <신설 2024.1.30>

⑥ 포상금의 지급 기준 및 절차, 제2항제2호에 해당하는 불송치결정 또는 불기소처분의 사유, 반환금액의 납부절차, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <신설 2024.1.30>
