공공단체등 위탁선거에 관한 법률 제18조(후보자등록)

① 후보자가 되려는 사람은 선거기간개시일 전 2일부터 2일 동안 관할위원회에 서면으로 후보자등록을 신청하여야 한다. 이 경우 후보자등록신청서의 접수는 공휴일에도 불구하고 매일 오전 9시부터 오후 6시까지로 한다.

② 후보자등록을 신청하는 사람은 다음 각 호의 서류 등을 제출하여야 한다.

③ 관할위원회가 후보자등록신청을 접수한 때에는 즉시 이를 수리한다. 다만, 제2항제1호부터 제3호까지의 규정에 따른 서류 등을 갖추지 아니한 등록신청은 수리하지 아니한다.

④ 후보자가 되려는 사람은 선거기간개시일 전 60일부터 본인의 범죄경력(해당 법령이나 정관등에서 정하는 범죄경력을 말한다. 이하 같다)을 국가경찰관서의 장에게 조회할 수 있으며, 그 요청을 받은 국가경찰관서의 장은 지체 없이 그 범죄경력을 회보(回報)하여야 한다. 이 경우 회보받은 범죄경력은 후보자등록시 함께 제출하여야 한다. <신설 2024.1.30>

⑤ 관할위원회는 후보자등록마감 후에 후보자의 피선거권에 관한 조사를 하여야 하며, 그 조사를 의뢰받은 기관 또는 단체는 지체 없이 그 사실을 확인하여 해당 관할위원회에 회보하여야 한다. <개정 2024.1.30>

⑥ 관할위원회는 제4항 후단에 따라 제출된 범죄경력에 대하여 그 확인이 필요하다고 인정되는 경우에는 후보자등록마감 후 지체 없이 해당 위탁단체의 주된 사무소 소재지를 관할하는 지방공소청 또는 지방공소청 지청의 장에게 해당 후보자의 범죄경력을 조회할 수 있고, 해당 지방공소청 또는 지방공소청 지청의 장은 그 범죄경력의 진위여부를 지체 없이 관할위원회에 회보하여야 한다. <신설 2024.1.30, 2026.3.24>

⑦ 후보자등록신청서의 서식, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <개정 2024.1.30>
