공공단체등 위탁선거에 관한 법률 제15조(선거인명부의 작성 등)

① 위탁단체는 관할위원회와 협의하여 선거인명부작성기간과 선거인명부확정일을 정하고, 선거인명부를 작성 및 확정하여야 한다. 다만, 조합장선거 및 이사장선거의 경우에는 선거일 전 19일부터 5일 이내에 선거인명부를 작성하여야 하며, 그 선거인명부는 선거일 전 10일에 확정된다. <개정 2023.8.8>

② 위탁단체는 선거인명부를 작성한 때에는 즉시 그 등본(전산자료 복사본을 포함한다. 이하 이 항에서 같다) 1통을, 선거인명부가 확정된 때에는 지체 없이 확정된 선거인명부 등본 1통을 각각 관할위원회에 송부하여야 한다. 이 경우 둘 이상의 투표소를 설치하는 경우에는 투표소별로 분철하여 선거인명부를 작성ㆍ확정하여야 한다. <개정 2024.1.30>

③ 제2항에도 불구하고 동시조합장선거 또는 동시이사장선거를 실시하는 경우 위탁단체는 중앙선거관리위원회규칙으로 정하는 구역단위로 선거인명부를 작성ㆍ확정하여야 하며, 중앙선거관리위원회는 확정된 선거인명부의 전산자료 복사본을 해당 조합 또는 금고로부터 제출받아 전산조직을 이용하여 하나의 선거인명부를 작성한 후 투표소에서 사용하게 할 수 있다. 이 경우 위탁단체는 선거인명부 등본을 제출하지 아니할 수 있다. <개정 2023.8.8, 2024.1.30>

④ 위탁단체는 선거인명부작성개시일 전 30일까지(보궐선거등의 경우 그 실시사유가 발생한 날부터 5일까지) 해당 위탁단체의 조합원 자격 등을 확인하여 회원명부(그 명칭에 관계없이 위탁단체가 해당 법령이나 정관등에 따라 작성한 구성원의 명부를 말한다)를 정비하여야 한다. <신설 2024.1.30>

⑤ 동시조합장선거 및 동시이사장선거를 실시하는 경우 위탁단체는 선거인명부의 작성을 위하여 「주민등록법」 제30조에 따라 주민등록전산정보자료를 이용할 수 있다. <신설 2024.1.30>

⑥ 선거인명부의 작성ㆍ수정 및 확정 사항과 확정된 선거인명부의 오기 등의 통보, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <개정 2024.1.30>
