공공단체등 위탁선거에 관한 법률 제14조(선거일)

① 동시조합장선거 및 동시이사장선거의 선거일은 그 임기가 만료되는 해당 연도 3월 중 첫 번째 수요일로 한다. 다만, 「신용협동조합법」에 따른 동시이사장선거의 선거일은 그 임기가 만료되는 해당 연도 11월 중 두 번째 수요일로 한다. <개정 2023.8.8, 2024.1.30, 2025.8.14>

② 동시조합장선거ㆍ동시이사장선거 외의 위탁선거의 선거일은 관할위원회가 해당 위탁단체와 협의하여 정하는 날로 한다. <개정 2023.8.8>

③ 관할위원회는 그 관할구역에서 공직선거등이 실시되는 때에는 해당 공직선거등의 선거일 또는 투표일 전 30일부터 선거일 또는 투표일 후 20일까지의 기간에 속한 날은 위탁선거의 선거일로 정할 수 없다. 다만, 임기만료에 따른 지방자치단체의 의회의원 및 장의 선거가 실시되는 때에는 그 선거일 전 60일부터 선거일 후 20일까지의 기간에 속한 날은 위탁선거의 선거일로 정할 수 없다.

④ 관할위원회는 제2항에 따라 선거일을 정한 후에 공직선거등의 실시 사유가 발생하여 선거사무일정이 중첩되는 때에는 해당 위탁단체와 다시 협의하여 위탁선거의 선거일을 새로 정할 수 있다. 이 경우 임의위탁선거는 그 위탁관리 결정을 취소할 수 있다.

⑤ 제4항에 따라 선거일을 새로 정하는 경우 해당 정관등에 따른 선거일로 정할 수 있는 기간이 공직선거등의 선거사무일정과 중첩되는 때에는 그 정관등에도 불구하고 위탁선거의 선거일을 따로 정할 수 있다.

⑥ 관할위원회는 선거인명부작성개시일 전일까지 선거일을 공고하여야 한다. 이 경우 동시조합장선거 및 동시이사장선거에서는 선거인명부작성개시일 전일에 선거일을 공고한 것으로 본다. <개정 2017.12.26, 2023.8.8>
