고위공무원단 인사규정 제27조(직위를 부여받지 못한 기간의 계산)

① 제18조제1호부터 제4호까지의 사유 또는 그에 상응하는 사유로 직위를 부여받지 못한 기간은 다음 각 호의 어느 하나에 해당하는 경우에만 법 제70조의2제1항제3호 및 같은 항 제4호나목의 기간에 산입(算入)한다. <개정 2016.1.7, 2023.8.30>

② 제1항제1호에도 불구하고 부여될 직위가 예정된 경우로서 해당 직위 부여를 위하여 필요한 절차를 진행하는 중에 2개월이 경과하는 경우 등 불가피한 사유로 제1항제1호에 해당하게 된 경우에는 인사혁신처장과 협의하여 법 제70조의2제1항제3호 및 같은 항 제4호나목의 기간에 산입하지 아니할 수 있다. <개정 2016.1.7, 2023.8.30>

③ 제18조제5호부터 제8호까지의 사유 또는 그에 상응하는 사유로 직위를 부여받지 못한 기간은 그 직위를 부여받지 못한 날부터 법 제70조의2제1항제3호 및 같은 항 제4호나목의 기간에 산입한다. 다만, 제18조제7호의 사유에 해당하는 경우로서 해당 형사사건이 임용령 제31조제2항제2호다목2)나) 또는 다)에 해당하게 된 경우에는 그 해당하게 된 날부터 소급하여 그 기간을 산입에서 제외한다. <개정 2023.8.30, 2026.9.29>

④ 제13조에 따라 임용된 일반직 고위공무원에게 종전 고위공무원단 직위에 재직할 당시 제3항에 따라 직위를 부여받지 못한 기간이 있는 경우에는 그 기간을 합산한다.

⑤ 소속 장관은 제1항부터 제3항까지의 규정에 따라 직위를 부여받지 못한 기간을 법 제70조의2제1항제3호 및 같은 항 제4호나목의 기간에 산입하거나 산입에서 제외한 경우에는 지체 없이 그 사실을 인사혁신처장에게 통보하여야 한다. <개정 2013.3.23, 2014.11.19, 2016.1.7, 2023.8.30>
