① 제2조의 상시 사용하는 근로자 수의 산정 방법은 다음 각 호의 구분에 따른다.

② 제1항제1호 중 "건설업"이란 「통계법」에 따라 통계청장이 고시하는 한국표준산업분류표상의 건설업을 말하고, "공사실적액"이란 총 공사실적액(2008년 건설공사의 총기성공사금액을 말한다)에서 「건설산업기본법」이나 그 밖의 관계 법령에 따라 적법하게 하도급된 부분의 공사금액을 제외한 금액을 말하며, "건설업 월평균임금"이란 「통계법」 제3조에 따른 지정통계 중 노동부장관이 작성하는 사업체임금근로시간조사의 건설업 임금을 기준으로 하여 노동부장관이 산정ㆍ고시하는 평균임금을 말한다.
