고압가스 안전관리법 제9조(허가ㆍ등록의 취소 등)
High-Pressure Gas Safety Control Act, Article 9 (Revocation of Permits and Registrations, etc.)
① 허가관청, 등록관청 또는 신고관청은 사업자등이 다음 각 호의 어느 하나에 해당하면 그 허가나 등록을 취소하거나 그 사업자등에게 영업장 폐쇄(신고한 사업자에 한정한다. 이하 이 조에서 같다) 또는 6개월 이내의 기간을 정하여 그 사업의 정지나 제한 또는 저장소의 사용 정지나 사용 제한을 명할 수 있다. 다만, 제1호, 제3호, 제5호 또는 제43호에 해당하는 경우에는 그 허가나 등록을 취소하거나 영업장 폐쇄를 명하여야 한다. <개정 2008.2.29, 2009.5.21, 2013.3.23, 2014.1.21, 2015.1.28, 2018.3.20, 2018.12.11, 2020.2.4, 2025.10.1>
(1) The permitting authority, registration authority, or reporting authority may revoke the permit or registration of a business operator, etc. or order the business operator, etc. to close its place of business (limited to business operators who have made a report; hereinafter the same shall apply in this Article), or to suspend or restrict its business, or suspend or restrict the use of a storage site, for a period not exceeding six months, where the business operator, etc. falls under any of the following. In cases falling under subparagraph 1, 3, 5, or 43, however, the permit or registration shall be revoked or closure of the place of business shall be ordered:
1. 거짓이나 그 밖의 부정한 방법으로 제4조제1항 또는 제5항에 따른 허가를 받거나 같은 조 제2항에 따른 신고를 한 경우 또는 제5조, 제5조의3 또는 제5조의4에 따른 등록을 한 경우
1. Where the operator obtained a permit under Article 4 (1) or (5), made a report under paragraph (2) of the same Article, or made a registration under Article 5, 5-3, or 5-4 by false or other wrongful means;
2. 허가를 받은 날이나 등록을 한 날부터 정당한 사유 없이 1년 이내에 그 사업 또는 저장소의 사용을 시작하지 아니하거나 1년 이상 계속하여 그 사업 또는 저장소의 사용을 중단한 경우
2. Where the operator has not commenced use of the business or storage site within one year from the date of obtaining the permit or making the registration without a justifiable reason, or has suspended use of the business or storage site continuously for at least one year;
3. 고의나 과실로 공중(公衆)이나 사용자에게 현저히 위해(危害)를 미치게 한 경우
3. Where the operator intentionally or negligently caused significant hazard to the public or users;
4. 제4조에 따른 허가기준에 미달하게 되거나 제5조, 제5조의3 또는 제5조의4에 따른 등록기준에 미달하게 된 경우
4. Where the operator has fallen short of the permit criteria under Article 4 or the registration criteria under Article 5, 5-3, or 5-4;
5. 제6조 각 호의 어느 하나에 해당하게 된 경우. 다만, 법인의 대표자가 그 사유에 해당하게 된 경우로서 3개월 이내에 대표자를 바꾸어 임명한 경우와 피상속인이 사망한 날부터 6개월 이내에 상속인이 다른 사람에게 그 사업을 양도하는 경우는 제외한다.
5. Where the operator has come to fall under any subparagraph of Article 6; provided that this shall not apply where the representative of a corporation came to fall under the grounds and the representative was replaced within three months, or where the heir transfers the business to another person within six months from the date of the decedent's death;
6. 제10조제1항을 위반하여 안전점검을 하지 아니하거나 위해 예방에 필요한 사항을 계도(啓導)하지 아니한 경우
6. Where the operator failed to conduct a safety inspection or failed to guide matters necessary for hazard prevention, in violation of Article 10 (1);
7. 제10조제2항을 위반하여 시설을 개선하도록 하지 아니한 경우
7. Where the operator failed to have facilities improved, in violation of Article 10 (2);
8. 제10조제3항을 위반하여 고압가스의 공급을 중지하지 아니하거나 공급 중지 사실을 신고하지 아니한 경우
8. Where the operator failed to suspend the supply of high-pressure gas or failed to report the suspension of supply, in violation of Article 10 (3);
9. 제10조제4항에 따른 개선 명령을 위반한 경우
9. Where the operator violated an order for improvement under Article 10 (4);
10. 제10조제5항에 따른 안전점검자의 자격ㆍ인원, 점검장비, 점검기준 등이 기준에 미달한 경우
10. Where the qualifications and number of safety inspectors, inspection equipment, inspection standards, etc. under Article 10 (5) fall short of the standards;
11. 제11조제1항을 위반하여 안전관리규정을 제출하지 아니한 경우
11. Where the operator failed to submit safety management regulations, in violation of Article 11 (1);
12. 제11조제3항을 위반하여 제조공정ㆍ자체검사방법 등을 안전관리규정에 포함시키지 아니한 경우
12. Where the operator failed to include manufacturing processes, self-inspection methods, etc. in the safety management regulations, in violation of Article 11 (3);
13. 제11조제4항에 따른 변경 명령을 위반한 경우
13. Where the operator violated an order for change under Article 11 (4);
14. 제11조제5항을 위반하여 안전관리규정을 지키지 아니하거나 그 실시기록을 작성ㆍ보존하지 아니한 경우
14. Where the operator failed to comply with the safety management regulations, or failed to prepare and retain records of their implementation, in violation of Article 11 (5);
15. 제11조의2를 위반하여 표시를 하지 아니한 경우
15. Where the operator failed to make markings, in violation of Article 11-2;
16. 제13조제1항을 위반하여 시설기준과 기술기준을 준수하지 아니한 경우
16. Where the operator failed to comply with facility standards and technical standards, in violation of Article 13 (1);
17. 제13조제2항을 위반하여 점검기준에 맞지 아니한 용기에 충전한 경우
17. Where the operator filled a container that did not meet inspection standards, in violation of Article 13 (2);
18. 제13조제4항을 위반하여 용기를 안전하게 유지ㆍ관리하지 아니한 경우
18. Where the operator failed to safely maintain and manage containers, in violation of Article 13 (4);
18의2. 제13조제5항을 위반하여 충전ㆍ판매 기록을 작성ㆍ보존하지 아니한 경우
18-2. Where the operator failed to prepare and retain filling and sales records, in violation of Article 13 (5);
19. 제13조의2제2항에 따른 변경 명령을 위반한 경우
19. Where the operator violated an order for change under Article 13-2 (2);
20. 제13조의2제3항을 위반하여 안전성향상계획을 충실히 이행하지 아니한 경우
20. Where the operator failed to faithfully implement a safety improvement plan, in violation of Article 13-2 (3);
21. 제15조제1항을 위반하여 안전관리자를 선임하지 아니한 경우
21. Where the operator failed to appoint a safety manager, in violation of Article 15 (1);
22. 제15조제3항을 위반하여 신고하지 아니하거나 다른 안전관리자를 선임하지 아니한 경우

30. 제16조의2제1항을 위반하여 검사를 받지 아니한 경우

34. Where the operator transferred, leased, or used containers, etc., or displayed them for sale, without undergoing inspection or re-inspection, in violation of Article 17 (5);
35. 제17조제7항을 위반하여 용기등을 제조하거나 수입하는 사실을 알리지 아니한 경우
35. Where the operator failed to give notice of manufacturing or importing containers, etc., in violation of Article 17 (7);
36. 제18조제2항 또는 제3항에 따른 회수등의 명령을 위반한 경우
36. Where the operator violated an order for recall, etc. under Article 18 (2) or (3);
36의2. 제18조의2제3항을 위반하여 품질기준에 맞지 아니한 고압가스를 판매 또는 인도하거나 판매 또는 인도할 목적으로 저장ㆍ운송 또는 보관한 경우
36-2. Where the operator sold or delivered high-pressure gas not meeting quality standards, or stored, transported, or kept it for the purpose of sale or delivery, in violation of Article 18-2 (3);
36의3. 제18조의3제1항에 따른 품질검사를 받지 아니하거나 같은 조 제2항에 따른 품질검사를 거부ㆍ방해ㆍ기피한 경우
36-3. Where the operator failed to undergo a quality inspection under Article 18-3 (1), or refused, obstructed, or evaded a quality inspection under paragraph (2) of the same Article;
36의4. 제20조제6항을 위반하여 특정고압가스를 공급할 때 같은 항 각 호의 사항을 확인하지 아니한 경우
36-4. Where the operator failed to verify the matters in the subparagraphs of Article 20 (6) when supplying specific high-pressure gas, in violation of the same paragraph;
36의5. 제20조제7항을 위반하여 특정고압가스 공급을 중지하지 아니하거나 공급 중지 사실을 신고하지 아니한 경우
36-5. Where the operator failed to suspend the supply of specific high-pressure gas or failed to report the suspension of supply, in violation of Article 20 (7);
37. 제22조제1항을 위반하여 산업통상부령으로 정하는 기준에 따르지 아니한 경우
37. Where the operator failed to comply with the standards prescribed by Ordinance of the Ministry of Industry and Trade, in violation of Article 22 (1);

40. 제24조제1항에 따른 조치 명령을 위반한 경우
40. Where the operator violated an order for measures under Article 24 (1);
41. 제24조제2항에 따른 이전ㆍ사용정지ㆍ제한ㆍ폐기 명령을 위반한 경우
41. Where the operator violated an order for relocation, suspension or restriction of use, or disposal under Article 24 (2);
42. 제25조제1항을 위반하여 보험에 가입하지 아니한 경우
42. Where the operator failed to take out insurance, in violation of Article 25 (1);
43. 사업의 정지나 제한 또는 저장소의 사용 정지나 사용 제한 기간 중에 사업을 하거나 저장소를 사용한 경우
43. Where the operator conducted business or used a storage site during the period of suspension or restriction of the business or suspension or restriction of the use of a storage site.
② 제1항에 따른 위반행위별 처분기준은 그 사유와 위반 정도를 고려하여 산업통상부령으로 정한다. <개정 2008.2.29, 2013.3.23, 2025.10.1>
(2) Standards for dispositions for each violation under paragraph (1) shall be prescribed by Ordinance of the Ministry of Industry and Trade, taking into account the grounds and the degree of violation.
